Sleeping men found with drugs get suspended sentence

- Police forgets to mention Guyana currency was placed in evidence

ROAD TOWN, Tortola, VI- Jariel Harrigan and Dillon Findlay, who were found guilty of Possession of a Controlled Drug with Intent to Supply to Another, were spared an immediate prison term when they appeared before Magistrate Ayanna O. Baptiste-DaBreo for sentencing on Thursday, September 26, 2019.

Instead, the men, who were found with 41 grams of cannabis during a police operation in the Ghetto/Crabbe Lot area in 2015, received a nine-month sentence suspended for one year.

“I do believe a sentence of imprisonment is warranted,” the magistrate said.

She explained; however, that the sentence would be imposed only if either of the men are convicted of a new criminal offence between September 26, 2019, to September 25, 2020.

“Behave yourselves!” she warned the men.

Prosecutors said the men were asleep when the police found them in a vehicle with the drugs, a quantity of cash, wrapping paper and an undisclosed number of dime bags.

Due to the find, the men were charged with the offence.

‘Mysterious’ Guyana currency affects case

During the trial, the appearance of $20 in Guyana currency affected the case.

Prosecutors had attempted to enter the cash found on the men as an exhibit, but it was denied after the unaccounted $20 bill was found inside the evidence bag with the rest of the cash.

“I have no evidence of how it came to be into the bag. Where did it magically appear from?” Magistrate DaBreo queried.

“Based on that concern, I will not allow this $602 plus the Guyanese currency into evidence because I have no evidence of [how the Guyanese $20 came into custody],” Magistrate Baptiste-DaBreo added.

One of the police officers then told the court that it was his fault, as he had forgotten to mention that the foreign currency was found in Findlay’s possession that night.

No charges were laid in relation to Possession of Proceeds of Criminal Conduct.

    What a shame. Those men got off to run more drugs because of the carelessness of this officer. Police Officers need to get more serious in case preparation before trials.

      Why so defensive officer? Was it you who didn't do your job properly or one of your down island colleagues who just come here only looking a cheque and dnt care bout police work,

    Great work by the magistrate. Its time the police pay for their mistakes. For too long they been getting the benefit of doubt while young men lives get destroyed... Happy these two young men get a second chance to redeem and do better. Get work... Be good citizens. Jail is never the answer ...

      Do you know the police shoot that boy that same night. Wild he was sleeping in the car. Police got to start to pay for the crime they are doing. They getting away with everything they do.

    Is this a typo? Caught with drugs in 2015 and 4 years later makes it to court? No wonder evidence was messed up
