ROAD TOWN, Tortola, VI- The alleged witch-hunt and harassment of locals by the United Kingdom (UK) police officers continue under the pretext of the Commission of Inquiry (CoI). Many residents have lambasted the one-man commission's report as biased and its credibility is under attack, since all of the areas that have issues under the Governor’s portfolio (civil service, courts, police force) have not been touched in the report.

It was yesterday, Tuesday, February 14, 2023, that UK police officers arrested and released Comptroller of Customs Wade N. Smith on “suspicion of breach of trust.”

Smith is the target of UK Officers

Mr Smith's home was searched, his phone and computer taken and he was released with no charges. Mr Smith was sent on leave by Governor John J. Rankin, CMG on August 18, 2022, with no explanation. He has since taken the Government to court seeking a Judicial Review over the decision to send him on leave without cause. The court said there is a case to answer on the lawfulness of Mr Rankin’s decision and a hearing is set.

In the CoI report, the one-man Commissioner Gary R Hickinbotom found no corruption in the Customs Department under Mr Smith’s leadership.

Therefore, many residents see Mr Smith’s continued harassment as revenge. It was Mr Smith who debunked the UK Police Officers' claim last year when they went on a 'joy ride’ and 'bar hop' with a Government boat but claimed they were on a special operation.

Mr Smith had noted that whenever there is a special sea operation, both his department and the police are involved jointly. No UK police officers were disciplined for the abuse of power and breach of trust.

Rankin & Collins treated differently under law

In addition, the Royal Virgin Islands Police Force (RVIPF) was involved in Human Trafficking last year, when they took a potential employee, who came to the Virgin Islands (VI) on a vacation, to St Thomas, USVI on a police boat so he could change his immigration status. Nothing was done on this matter but today the officer is in the police force, as he was hired in October of last year.

It was Mr Smith as Comptroller of Customs, along with the Chief Immigration Officer, who made representation and provided evidence to the Director of Public Prosecutions (DPP) on the matter; however, it was swept under the rug and nothing was done.

Up to publication time, Mr Smith could not be reached for comments.

Residents continue to point out the double standards where the Governor and Police Commissioner get away with unethical behaviour, but local residents are dragged through the courts.

Governor John Rankin told the Territory that he knew nothing about the plot to have former Premier Andrew A. Fahie arrested; however, a month later we found out he had authorised the sting operation against Mr Fahie. There were no sanctions for his untruthfulness.

Double standards based on race?

Police Commissioner Mark Collins released a video that many described as racist and portraying the VI as a narco-state and crime-infested destination. He lied when he said he did it in collaboration with the BVI Tourist Board as a recruitment plug. We found out that this was not so as the Tourist Board Director Mr Clive McCoy debunked his claims, saying the Tourist Board had nothing to do with the despicable video.

There were no sanctions against Mr Collins for breach of trust and the Governor, his pal, said he forgave him.

Meanwhile, patriot and model civil servant Najan Christopher is before the courts for writing a letter saying the former Premier was Head of Government at the time of his April 2022 arrest and diplomatic immunity should be considered.

Most recently, Governor Rankin has been pushing the Police Bill that strips residents of their rights, as police can search homes and businesses without a warrant and fingerprints and DNA tests can be kept for over seven years even if the person is not convicted of a crime.

The Bill will also allow residents to reveal their conversations between lawyer and client. The Bill being pushed by Mr Rankin in its current form will allow the courts to draw negative inferences from a person exercising their right to silence.

      We are just not used to that here but it’s how it’s meant to be done. Of people are innocent, there’s not a problem. If I was asked questions about corruption I wouldn’t care because I’m not corrupt.

I ask because there are many rumors on the street about a few of them even more than in this story with VINO which are 100% correct but how can they look into us, but no one can look into them except themselves.     When will the people of the BVI get real justice? The UK commissioner of police and a few of his Uk officers and sidekicks should have already been arrested for abuse of power. These are only some of the reasons they hate Mr. Smith because he caught them red handed doing wrong but the Governor let the same commissioner of police investigate himself and of course as expected found himself and his side kicks innocent. This is now totally out of hand and the people need to know what all is really going on in this place. I am not a fan of Vino, but the crimes committed by the UK commissioner of police in the article are true and there are more.     The police and every subject under the Governor are failures and have too many unanswered questionable conducts. This is why I say the position of the Governor should be an elected one so they can be held accountable by the people and the laws of the land. Also, so we can check their bank accounts and assets before they took office, while in office, and after, so they do not run off with our money and hide it in Switzland or other places in the world in their family's names while having us looking at each other in the BVI as the thieves and corrupt because they have the power of investigation to keep our eyes off of them like they are doing with this gentleman and others.

    Breach of Trust is a wide ranging non specific charge that allows the police to continue investigations and prevents government employed suspects from returning to work. This is not the only charge those accused of it are likely to face.

    UK Officials are ignoring our democracy and democratic rights as a people of the BVI because they have deadlines in their pre-authored COI recommendations on legislation and policies to be passed which means they do not care if they are the best thing for the people of the BVI or not. They are quite aware the deadlines they imposed are unreachable. Just get it done when and how they say. This means that the House of Assembly and the public service is now a rubber stamp for the Governor and his UK bosses and to hell with democracy. This is a slap in the face of democracy and certainly does not reflect a true modern partnership. For example, clearly the Governor and his UK counterparts are angry the Police Act was not passed as they send it to the House of Assembly to be passed and passed immediately without amendments. As a result, they are coming for blood through abuse of power like what they are doing to this young man and other public officers but will try to package it as otherwise as the Governor did in his latest press conference. This is a full dictatorship, and we need to rise up NOW!

Now the UK officers and their commissioner are through the public posing as tourist listening to the gossip in the rum shops, restaurants, taxi stand and all over, and then going in the office to file paperwork to search, pick-up persons, and then try to charge them on suspicion. If suspicion is a charge, then the whole BVI will soon be charged. When will our people see and understand this plot that is at hand in our land that is being disguised as good governance is really to try to enslave us because they hate us.       Plenty people in the BVI call people name in many things but that does not make it true. This is the point though. The wrong doings of the commissioner and his kind in the force are called out all the time but they are dismissed by the very commissioner and his kind in the force who are allowed to quietly investigate themselves and clear themselves without tarnishing their names publicly even if they end up innocent.
