Rosan believes Sr Magistrate Richards should be sent home 'under review'

- following ruling against her in case involving Wade N. Smith

ROAD TOWN, Tortola, VI – Talk show host Rosemary L. Rosan aka ‘Cindy’ has accused Senior Magistrate Tamia N. Richards of abusing power in the case with Wade N. Smith where Justice Sonia Young on April 24, 2024, found the actions of the Senior Magistrate unreasonable and lacked substance and not justified.

Ms Rosan was at the time speaking on the April 24, 2024, edition of “The Morning Ride Show With A Side Of Politics’ on ZROD 103.7 FM radio in the Virgin Islands.

Ms Rosan said the ruling shows the Sr Magistrate abused her power.

Smith was sent on Administrative leave over a year ago and faced charges of Breach of Trust as a Public Officer. According to the details, when Magistrate Richards granted a warrant for Mr Smith's residence to be searched, it resulted in his phone and other equipment being seized, including documents with no connection to the charges. 

The court also found that the Magistrate ought to have given her reason for issuing the warrant, and it did not require her to be elaborate, but she could not be made to disregard the rights of the individual.

The court also ruled that while the Magistrate's Code provides the Magistrate with authority to issue warrants, the Magistrate should have done so in consideration of Mr Smith's right to privacy and more.

Majestrate 'did what she want' - Rosan 

Rosan said the entire case, which resulted in Smith winning, seems like the magistrate was unreasonable and ‘did what she wanted’ which compromised herself.

“So the whole thing is just, I want to use the term miscarriage of justice…. Anywhere else in the world… Tamia would have been at home, under review,” she said.

She added that cases that the magistrate touched would have also been under review as well, "Why did she do that? Was there pressure coming from somewhere? Is it that you allow yourself to be compromised to save your job?” Rosan questioned, adding that something went wrong. 

“I wouldn’t blame her alone, something entirely went wrong… maybe it was her, the Commissioner of Police, the police whatever, together... but this was a miscarriage, a travesty,” she said.

    all kind of problems in such a small tiny territory. other people are struggling in life with all kind of hardship. other people in the world are homeless and jobless and penniless sleeping outside on the sidewalk and the pavement because they have no financial means in this world to provide for themselves in order to take care of themselves. other people in the world are poor and needy and downtrodden. they have no finances to pay rent and to pay mortgage in order to have a place to live. there are many people in this world that have been homeless all the days of their lives because they cannot better there living condition to have a roof over their heads and to buy food and pay for living expenses. there are other people in the world that have far more problems and hardship than people living in the british virgin islands. what kind of crazy and insane games are people playing in the bvi with other people lives? people have nothing better to do in this short lifetime that to find means to trouble and to harrass and provoke other people with their obnoxious behavior.

She is disrespectful, quick to pull tantrum. Don't allow people to talk.. Because she failed at her job. She wish everyone the same. Leave the magistrate alone..She will be vindicated.

    Giving the warrant is justified but doing it in a sloppy fashion is not especially as it gives Mr Smith room to wiggle out of an issue’s he maybe guilty of.

    I agree with Cindy for once. Too much arrogance has taken over the bench and she has gotten too personal and basically full of herself as if she is larger than life. Wish we would all understand that no position is permanent and one day life will humble you if you don't humble yourself.

    Based on Cindy's reply, she sounds off topic. Like someone waiting for another to fall so they can take that as a opportunity to tell the person how they really been feeling for years. It is a learning curve. Now we as a people know what to expect in a warrant and can challenge it and the magistrates know better what needs to be considered. It is called growth. Sometimes growing is painful but it should not be used as an opportunity to b8h about someone else. The magistrate did a man wrong and we can fix that. Cindy encourage Lorna to do the entire country wrong and we cannot fix that for another 3 years. Both situations are terrible but which one have the country hurting the most?

    There are those who beleived that Tamia would have gone there and "let go" our own people but as it is said "justice is blind" Tamia did not matter who you are or where you from she deals with you on the basic of law and the evidence that is proven and before her, whether such evidence it for or against the defense or the prosecution. I am not saying that she has been perfect but the persons who are against her are those who had allegedly committed a crime/offense or knew someone knew soneone who did and her rulings have not gone in their favour.

    over ten years ago I was wrongfully convicted by this same Majestrate, I was going through a difficult time with my then wife who wanted to take my house in the name of marriage, a house she meet me with ,I Was accuse by my then wife of violence against her and with zero evidence this Majestrate say she is bringing me guilty,(WHY) the reason the Majestrate say she was bringing me guilty was because during my testimony I said the house was mine, i was the ordered to pay the court and my ex $2000 each, so when you break it down this Majestrate reward a criminal who lie to the police and punish an innocent person this sitaution hurts to this day and it brings back heart breaking memories especially when i see or hear of Miss Richards

    But you see, a judge in such a position, with questionable rulings, can be a win for many criminals on many fronts!

    For if she continues to make irrational rulings, where defense attorneys, can argue ,and have her rulings vacated, then, this is a magistrate whose rulings would be welcomed on all fronts!

    Her continuance in this position causes the miscarriage of justice, and, for many, signals the end of presumably guilty persons, actually being found guilty!

Little know secret- the govt pays settlements to all these people whose cases are dropped because the prosecution is so less.
