CHARLOTTE AMALIE, St Thomas, USVI- District Court Judge Mark Kearney has granted a travel request from former Office of Management and Budget Director Jenifer O'Neal as he mulls over her arguments in favour of a retrial or overturning her fraud and bribery conviction altogether.

Ms O'Neal told the court that she needs to visit her Maryland home for 10 days beginning January 8 for a slew of medical appointments. A motion filed by her attorney assured the court that prosecutors had no objection to the travel. A recommendation that the trip be limited to only 7 days was made before becoming aware of the length of time required for Ms O'Neal to receive all the services she is traveling for, the court was told.

In his order granting the request, Judge Kearney mandated that Ms O'Neal's travel be limited to only the medical appointments previously outlined; that means no extraneous travel, visits, meals, or social occasions outside of her residence. She is required to produce and submit a detailed itinerary before the end of the day on Monday, and must return to St Thomas within 24 hours of her last appointment, but no later than January 18, as requested. During the trip, Ms O'Neal will have to check in to the probation office by telephone each day before 4:30 PM letting them know exactly where she went each day and if she met with anybody other than medical providers.

Stern warning

Judge Kearney ended with a stern warning: failure to adhere to the imposed conditions could result in the trip being cut short and Ms O'Neal being hauled before the court and possibly immediately remanded into custody.

In December, Ms O'Neal and co-accused former VIPD Commissioner Ray Martinez were convicted of fraud and bribery charges after a jury found them guilty of colluding to pad invoices and expedite payments for a company receiving contracts worth tens of thousands of taxpayer dollars.
