ROAD TOWN, Tortola, VI- Although stripped of the positions of Chairman of the Virgin Islands Party (VIP) and Premier of the Virgin Islands (VI), Honourable Andrew A. Fahie constitutionally is still the Representative for the First Electoral District, a title he has held since he was first elected in 1999.

Hon Fahie, while Premier of the VI and on an overseas engagement on behalf of the Territory, was arrested, along with Managing Director of the BVI Ports Authority (BVIPA) Oleanvine Pickering-Maynard, by the Drug Enforcement Administration (DEA) on April 28, 2022.

The former Premier, who has won in the First District for six consecutive elections, remains incarcerated at a detention facility in Miami, awaiting bail and trial.

Asked about Hon Fahie’s status as Representative for the First District at a press conference on May 13, 2022, the Premier and Minister of Finance in the newly sworn in National Unity Government, Dr the Honourable Natalio D. Wheatley (R7), confirmed that Hon Fahie still holds his elected post.

‘That's something for the Governor’- Premier Wheatley

Premier Wheatley explained that it is for the sitting Governor to strip Hon Fahie of his elected representative status.

"That's something for the Governor. If you look in the constitution you will see how a member of the House of Assembly (HoA) can be removed. It’s very clear there, a member can resign, if a member misses three sittings he can be removed and there are some other conditions, of course if they are declared insane or something like that but we have to look clearly in the constitution to see the conditions upon which you can be removed."

The Organisation of Eastern Caribbean States (OECS) in a statement on May 2, 2022, said “Like all persons charged with a criminal offense, Andrew Fahie is entitled to the presumption of innocence, procedural fairness, and a free and affair trial within a reasonable time.”

      @ SAME THING. Use your brain. This is not about personal friendship anymore. This is about what is best for the entire BVI. If he tries to stick by his friends, which they probably all are, then he cannot clean out the bad. This is a tough one for him because this is a small place where everyone knows each other, but scrap that. He has to prove himself as being the new leader and that means getting rid of friends and relatives too. Give the man a chance. I would like for you all to do better.

    Why would the Governor have the say in that? There should be a special election held within that District. Fahie automatically lost the confidence and trust of 1st District Constituents after being arrested as a Felon. Let the People select their choosen Representative.

      If he walks free from those charges bought by the Federal Government due to a DEA undercover sting he has been talking and I don't think he will be coming back here.
      That is highly unlikely though as I think the DEA have got who they want... I can't see them giving him a get out of jail free deal unless he can give them someone more high profile than him.

    The Governor has no jurisdiction over District one representation. Unless the District representative resigns or is convicted in the court or become incapacitated or dies, he or she is still the elected representative. To this end all the clamor and speculations are futile. it is rather unfortunate that we have arrived at this critical juncture of our political development.

    Let us don't be fooled by what transpired in recent days. There has been a plan to destabilize the Territory for many years and it was a well orchestrated plan and our former Premier fell into the trap. I am of the opinion that his security apparatus failed him because these so call operatives should not have gotten even close to the former Premier. They should have intercepted anyone who tried to get close to him. That would not have happened to any Cuban leader. The former Premier could have been killed because of the negligence of his security. In the future there should be measures in place to avoid future incidence of that nature.

If you read the article it pointed out the grounds on which a Representative could be deemed unfit and to be removed from Office. His alleged crimes placed him in one of these category. The next move is to play it out constitutionally so as to avoid any future potential legal challenge.. Respect the Constitution don't butcher it.

    What are the guidelines for a district rep to be removed from their seat other than being voted out? Does the district seat carry more weight than his position as premier and leader of the Virgin Islands ???????? party?? As I understand it, he is no longer the premier, a position that he received because 1) he was the leader of the VI Party and 2) He was voted in by the 1st district. By virtue that he was removed from the premier-ship and leader of the VI Party, how could his position as district rep be maintained??? Please make it make sense. Is he not an absentee rep? How long are we to remain in limbo? Did not the 1st district vote for 4 at-large candidates and do they no represent ALL of the 9 districts? Why haven’t the 4 at-large reps and the new premier and the AG and Governor come to the 1st district to have a meeting with us to discuss a way forward???
