Butler’s case adjourned, VC unable to attend court

ROAD TOWN, Tortola, VI - Michael Butler, who appeared before the Magistrate’s Court yesterday, September 19, 2012, charged by the Crown for wounding, had his matter adjourned to a later date, due to the absence of the Virtual Complainant.

On summoning the matter to be dealt with, Crown Counsel Sara Benjamin informed the court that the Virtual Complainant, could not make it to court, because she has been and still is receiving treatment for a month now, at the local hospital. 

Presiding over the Court, Magistrate Tamia Richards stated the crown was in contact with the brother of the VC, and was informed that she is no longer interested in the matter. 

Magistrate Richards added that it should be heard from the VC herself, while in the presence of the court. 

Allegedly, on April 17, 2012, the VC and her sister, who is the defendant’s girlfriend and mother of his child, got into an argument, where she then called him and informed him of what was going on.

The court heard that, on arrival at the home in Huntums Ghut, the defendant approached the VC, and accused her of interfering with his girlfriend. 

Allegedly, during a scuffle between the two, court records stated that he pushed her against a mirror, causing it to break, resulting in the VC receiving severe injuries.

    This is gone beyond ridiculous. The BVI needs to enact new legislation that states that in any instances of domestic violence the statements must be taken by police, photos taken of physical injuries, medical reports collected AND come court date, if the VC decides to drop the charges the police continue with the charges themselves. I also think there should be a fine for the VC for not showing up in Court for a a scheduled date. I'm sure she isn't at the doctor receiving treatment 24/7. She didn't show because she was too chicken to face the man and the court. The court should not be treated as a playground. $250 penalty for not making a court appearance should be mandatory!!!!!!!!!!!!

    I find that the court time is been wasted with these lil lil small matters maybe these should go before the Masters and the real cases come before the magistrate...just my two cents

    Send him ra$$ jail ahsram should have continued the matter your sister just as stupid, he will end up kill that girl. Let her keep going back, that boy does not care about nobody self but him self and he will continue to have other women and still beat her because he feels he is bad and no one can stop him, he needs to go jail bat looking....

    You are a friend of mines....but you are being foolish!! Hope you don't end up at the Prison for murdering him in self defense OR worse yet at DAVIS! Your sisters and mom need to knock some sence in your head. He hit you once, HE WILL DO IT AGAIN and it will be WORST next time!!!!!
