Alleged murder trio Bernard, Harrigan & Rodriquez remanded

- also charged with Taking of Conveyance

ROAD TOWN, Tortola, VI - Vernon Bernard, 26, a Dominica national, local resident Rafael Harrigan, 27, and Maybelline Rodriquez, 21, made their first appearances today, Tuesday, March 6, 2018 before Senior Magistrate Tamia N. Richards after being charged in relation to the murder of Trumayne J. Daway.

Bernard was charged for the murder of Mr Daway and unlawful possession of a firearm while Harrigan was charged for possession of a firearm. 21 year old Maybelline Rodriquez was charged with the murder of Mr Daway, information first and accurately broke by our newsroom at the weekend.

In addition, Bernard, Harrigan and Rodriquez were charged with Taking a Conveyance.

Harrigan was represented by Attorney-at-Law Patrick Thompson, while Bernard and Rodriquez were unrepresented.

All three accused were remanded into custody until the next court appearance, which is slated for Friday May 25, 2018.

Daway, 26, was found unresponsive in the driver’s seat of a vehicle with several bullet holes on the eastern side of Brandywine Bay on Wednesday, February 28, 2018.

    Young man/woman: we’re not perfect. No one is perfect. But not because we’re not perfect doesn’t mean we Can’t make better choices in life. Being under passion and pressure do cause for actions we regret.

      Actually this 'crime' is known as TCWOC or TWOC which is 'taking a conveyance without consent' and is a relic of the English law. Back in Victorian England young country lads would 'borrow' a horse or a horse drawn carriage to get home at night after the pubs closed. The borrowed conveyance would usually be found the next morning by the local constable who would then charge the landowner with TWOC. The penalty was usually a small fine, return of the conveyance to the owner and compensation for any damage. Somehow this quaint country law was applied to motor vehicles in the early 20th century and has somehow managed to survive into the 21st century. In the BVI dinghy thieves are usually charged with TWOC and are barely punished. TWOC is just one of these out of date laws we still have to live with in this British colony

    Didn't you hear what her role was, she was the honey trap, a British term used to lure one to their demise, although she was an accessory she was a planner of the event, so she is culpable of Murder (pre-meditated) this would be a matter for the jury to decide, if they say she not guilty, then she will walk. However been an accessory to murder could be a backup charge they got her on, if the jury says no to Murder, but as it is under English Law the Crown go for Murder or nothing, the chances for Murder with a jury is 50/50. Just check the case of The Queen v. Lorne Parsons, Clinton Ham and Selena Varlack, Court of Appeal, even reaching the British Privy Council. Read it and you'll get the jiss.
