Acquitted policeman seeking to have charges struck out from records

ROAD TOWN, Tortola, VI- Jamaica national Shawn Henry, the only policeman acquitted in the 2019 court matter where he and two others – Pamphill Prevost and Simon Power – were allegedly linked to missing money while they were executing search operations while on police duty between January 2012 to July 2014, is now seeking to have his record cleared in the judicial system.

According to a court document issued on the court’s website on February 18, 2022, through his attorney, the now acquitted man will be making two strike-out applications.

The first application will be made at 9:00am and the second at 10:00am before Master Alvin Pariagsingh on Wednesday, February 23, 2022, via Zoom.

Henry is being represented by Phoenix Law against the Attorney General of the Virgin Islands.

Initially, the three interdicted policemen had a string of charges relating to the missing monies stacked against them.

However, at the end of the case, which lasted nearly three months in 2019, Henry was acquitted and is now a free man.

Henry was accused of conspiracy to steal and was found not guilty by a jury.

Henry sued AG & CoP

Following the ruling, Henry filed a civil claim against the Attorney General and the Commissioner of Police seeking damages for false imprisonment and malicious prosecution.

He claims that he was incarcerated for over 30 days before he received bail at the high court.

In the meantime, the re-trial for Prevost and Henry started earlier this month at the high court before His Lordship the Honourable Justice Raymond C.S. Williams.

I am shocked at the number of dislikes on the God is watching comment. Why would it be unreasonable for someone clearly falsely accused and acquitted of all charges by a jury of our peers - same people dem ayo and I living thru and walking around with every day - to get his job back? Why ayo so? He right to sue. There is too much lack of accountability by the authorities here.

I THOUGHT IF A PERSON IS ACQUITTED OF ANY OFFENCE , THAT THE LAW WAS SUPPOSED TOF ERASE THE CHARGE , AND IF
A PERSON IS INNOCENT UNTIL PROVEN GUILTY . SO SINCE HE WAS ACQUITTED , HOW COME HE HAS TO CLEAR HIS NAME OR A RECORD ?
