Warner gets Stay of Extradition
A little over month ago a judge ruled that the extradition order signed for Warner in 2015 could proceed, after rejecting a judicial challenge against the legality of the order put forward by Warner’s attorneys. The lawyers had argued that the extradition proceeding previously signed with the United States in 2015 violated the rights of the country’s citizens as set out in parliament’s Extradition Act.
Justice James Aboud while agreeing that there were inconsistencies did not deem them enough to set aside the extradition order. Warner was, however, granted leave to file an appeal before the court reconvened this week and duly made use of the opportunity.
Chief Magistrate Maria Busby Earle- Caddle was notified of Warner’s appeal and the fact that he had been given a preliminary hearing on December 16, 2017 by attorney Netram Kowlessar, who represents United States in the matter.
Kowlessar explained that the preliminary hearing was set to determine Warner’s application for a stay of the matter currently before the judge, pending the determination of the substantial appeal.
Busby-Earle-Caddle agreed to adjourn the case to January 18, 2018 when Kowlessar and Warner’s attorneys are expected to report to her the outcome of the application for a stay of the proceedings in the magistrate’s court.
Warner is currently wanted in the United States on several charges of money laundering and corruptions related to his time with football body FIFA.
