Walwyn says he was authorised to have ESHS Wall Report

-Admits he went against procedure in releasing report to public

ROAD TOWN, Tortola, VI – Minister for Education and Culture, Myron V. Walwyn (AL), in an interview with Jahphix Television (JTV) Journalist, Ms Cathy O. Richards, says that based on the Audit Act, he would have been authorised to have a copy of Auditor General (AG), Ms Sonia M. Webster’s Elmore Stoutt High School (ESHS) Wall Report.

The wall commissioned by Mr Walwyn around ESHS, costing taxpayers some $1.6M was said to be built with little regard for public resources according to the AG in her report.

The report was then leaked to the public—in what Governor Augustus J. U. Jaspert called a breach of procedure—by Mr Walwyn in an attempt to have the first ‘spin’.

In the JTV interview, while the Minister admits that he may have gone against the normal procedure in releasing the report to the public, he says to declare that he breached the Audit Act would have been incorrect.

Act not breeched – Walwyn

 “To say that the audit act was breached… was incorrect. If you read the Audit Act, section 20 of the act I believe, when it comes to a special report, it says a copy of the special report should be given to the Governor who will cause it to be laid in the House of Assembly (HoA),” Hon Walwyn said during the December 17, 2018, interview. 

He said the Act also indicated that he should have been given a copy, “It also goes on to say in the following section, that a copy of the report should be given to the Minister and to the Financial Secretary… it doesn’t put any limits on the minister as to what he can do once he has that report.” 

In essence, Hon Walwyn says he was authorised to have the report and as such, could do with it as he pleases, “if the act authorises you to have a report, that means you’re an authorised person that have that report,” he said.

No sanctions

The embattled Co-leader of Government, Mr Walwyn further goes on to say that following that authorisation, there are no sanctions in the Act for the Minister or the Financial Secretary if they were to do anything different.

“Additionally, the making of the document public does not prejudice the Governor’s responsibility to have it laid before the House of Assembly because that is spelt out in the act,” he said. 

While Mr Walwyn underscored that from a procedural perspective, the leak should not have happened, he says the Audit Act should be tightened-up since it contains 'inadequacies'. 

“Perhaps now again is an opportunity to tighten up the laws of the country, particularly the Audit Act since we have clearly found some inadequacies based on what has happened.”

    So the minister who is a lawyer, knows the spirit of the law, but found a loophole and choose to take advantage of that loophole. Not illegal according to him but definitely unethical.

    So if he is Premier, he will use whatever loopholes exist in order to do what he wants? Very telling!

      @ Lb: that’s the issue with some legislation in this territory(loopholes).... flax give up being the speaker of the legislative council because his property was used to housed the BVI tourist board(conflict of interest)however the current house of assembly delegated is afflicted with a company which conducted business with a department(that department was declared a statuary body) so the current delegate was allowed to continue: most of our legislative regulations must be reviewed and patch those loopholes......none of the 13 thus far have presented any motions to house of assembly to fix those loopholes because it is not in their best political interest to fix those loopholes

      @ NEW NAME: The new name for Hon Walwyn is FACT MAN. It's very important to lay the facts out always and inform the populace. Our government agencies has many employees doing mediocre work messing with the reputation of good people. I've read numerous online articles where even the magistrate is frustrated with how lax the system has become. So i agree with Honorable Walwyn, lay the FACTS out and let the masses be informed. If in doing so we can identify ways to tighten up the system i think that's a good thing.

      Riddle me this: WHAT IS THE DEFINITION OF A PARADOX?
      For years government has been scorned for not producing audits to the public in a timely manner but when A minister releases it too early to the public, they're crying foul. Thats a paradox!

        No it is not a paradox....it is called saving his ass. The document was not completed and was clearly marked confidential not for public distribution. He himself chastized the governor for making a statement about the document before it was laid in the house and now he wants to back pedal. Stupes.....where did he really study law

    Myron Walwyn if you knew that you were entitled to a copy of the report, why did you gave a half baked apology when you were told that you breached procedure? Guess you never knew that until after the fact? If my memory serves me right, you received a draft copy of the report. Why then did you released the draft copy since it wasn't the final piece of work? Everyday I read what you have to say, is the more I am disappointed by your actions and statements. I would advise you to keep your mouth shut because the more you speak the more you are letting us know that you are plugging loop holes as the story unfolds daily. Let the investigation takes course and let the chip fall where they may. Word of advise MW, keep your dam mouth shut!!!

      @ Just Curious: Your memory is not serving you correctly: tell me where you read that Hon Walwyn leaked a DRAFT COPY of the audit?? I will wait!!

      What I've read is that a draft copy of the audit was sent from the AG's office to the minister. The ministry in turn highlighted many inaccuracies in the draft and supporting information was then sent to the Auditor General's office for thier edification. The AG office did not consider any of the new insight provided by the Ministry of Education and subsequently produced the "Special Report" which is the FINAL REPORT. This is the report that was presented to the public.

      You can not manufacture your own facts or if you're not certain of what you speak i think it would be wise for you to "KEEP YOUR DAMN MOUTH SHUT!!!"
