ROAD TOWN, Tortola, VI – The trial of two alleged Virgin Gorda ganja farmers has finally gotten underway today, May 15, 2013 after a number of snags had delayed its start previously.

Lenn Lennard and Bakembe George are jointly charged with the unlawful cultivation of cannabis. The men were allegedly discovered at Taylor Bay in Virgin Gorda near a huge field of marijuana plants on December 29, 2011.

Lennard is represented by Ms Anthea Smith while George is represented by Mr Patrick Thompson.

When the matter was called before the Magistrate’s Court today, Crown Counsel Herbert Potter announced that the Crown had three witnesses to offer testimony against the defendants.

Smith stated that disclosure had been made elsewhere but it was unclear what impact this would have on the case at this time. The attorney attempted to seek an adjournment before the trial proceeded, stating that she needed to seek further instructions from her client in an effort to shorten the matter, but this was disallowed.

Magistrate Richards said there would be no adjournment since George had been on remand “way too long”. She then confirmed that his lawyer was ready to proceed as previously stated.

The matter has been stood down for continuation later today.

Trial for alleged VG 'ganja farmers' halted again

ROAD TOWN, Tortola, VI – The trial involving Len Lennard and Bakembe George hit yet another snag before the Magistrate’s court even as the prosecution was prepared to proceed and half of the defence was also set to go yesterday, February 5, 2013.

The duo is jointly charged with the alleged cultivation of cannabis plants. The men were allegedly discovered at Taylor Bay in Virgin Gorda near a huge field of marijuana plants on December 29, 2011.

Crown Counsel Leslie Ann Faulkner told the court that there were three witnesses present and available to testify but an issue had arisen regarding counsel for Lennard – the firm responsible for his defence reportedly had no knowledge of the matter before the court and no representation was offered as a result. He was previously represented by Anthea Smith of the same firm.

Lennard is currently serving a sentence at Her Majesty’s Prison at Balsum Ghut for drug and firearm possession.

Meanwhile, George has now been on remand for approximately one calendar year owing to issues surrounding his ability to secure his bail. His bail situation is likely to be reviewed by the court pending discussions.

Senior Magistrate Tamia Richards said that it was unfair to George to be on remand for such a long time and noted that the situation did not prejudice Lennard who is currently serving time.

The court has resorted to writing the law firm regarding George’s representation.

The duo will return to court on February 7, 2013.
