ROAD TOWN, Tortola, VI - Eyes rolled and heads turned side-to-side on April 4, 2017 in the Magistrate’s Court presided over by Magistrate Ayanna O. Baptiste-DaBreo, when it was revealed that there was an excessive number of phone calls, 73, exchanged between Alston Penn and Santo Yamarco Hernandez between March 9 and 10, 2017.

Director of Public Prosecutions (DPP) Kim Hollis, QC is aggressively leading the prosecution case in the trial of Hernandez, 38, accused of the murder of Penn as occasioned on March 10, 2017.

Of note, as highlighted by Hollis during the accused murderer’s court appearance, was the fact that the last answered called on Penn’s phone record was at 2:00 AM, merely hours before his lifeless body was discovering lying partly naked in his blood on the road side in the Windy Hill area on the Western side of Tortola.

The Prosecution described the injuries to Penn’s body as “extensive” and “severe trauma” mainly to the face and skull. Two boulders covered in blood and clothing of Penn were also found on the scene.

In addition to the phone records, the DPP boss told the court about CCTV footage, which allegedly showed the accused Spanish speaking man driving a borrowed vehicle with which he picked up the differently abled man, Penn, around 11:00 PM on March 9, 2017 not far from Penn’s home in East End.

Accused had left territory on day of murder

The very day of the murder Hernandez left the territory for his home country, Dominican Republic, where he resided with his wife, children and mother. Here in the Virgin Islands he reportedly had another relationship which he claimed to have ended prior to March 9, 2017.

However, he apparently had no idea that police investigators were on to him and he was back in the territory on April 1, 2017 when police arrested him upon arrival at the Terrence B. Lettsome International Airport the moment he landed.

According to the Prosecution, Hernandez frequently travelled home to his family and his Facebook posts tell a lot of one side of his life; glamour, family and work.

Unemployed

The court heard that Hernandez had no fixed employment in the territory but worked in the construction industry. At the time of his arrest he had no job. He also told investigators that after separating from his VI girlfriend he was renting a room at Rudy’s Bar.

Hernandez was remanded to prison and was instructed by the Magistrate to get himself a lawyer as it was her opinion he shouldn’t even handle his paper committal matter without a lawyer. His case will be tried in the High Court.

The accused’s next Magistrate’s Court appearance is set for May 19, 2017.

Man charged for Alston Penn murder remanded

The man charged for the murder of Alston Penn made an appearance at the Magistrate’s Court today, April 4, 2017.

Santo Yamarco Hernandez, 38, native of the Dominican Republic, residing in Spring Ghut, was remanded to prison until his next court date.

Hernandez was charged on April 1, 2017 with Alston Penn’s murder.

The body of Penn was found on Windy Hill, Tortola on the morning of March 10, 2017.

When you are definitely right that alot of crimes will not be solved unless people with information do not come forward, please take into consideration. 1.     Thank you for catching the brute that allegedly committed this brutal crime. I did not know Penn but, he did not deserved what happened to him. I have faith that all the other unsolved will be solved in due time.     He picked up Alston at 11pm.
    Why would he need there be a last recorded call at 2 am if they were together?
    My conclusion is he we took him to another place or individual who can at to the story or there are more persons involved in this crime.

      Maybe they had an argument becoz the man was going to break up with the deceased and go home to his wife. Maybe he dropped the deceased off n tell him walk home. Maybe the deceased then called and threatened to expose him to his wife, friends, everybody. Maybe the deceased had more information on him than he thought. So after thinking and deciding to kill the deceased, he called him back around 2am, asked him where exactly he was at, met him there, pretending like he was going to make back up with him (hence the pants off) then killed him. This Santo Domingo woman who lives and works here was showing pictures of her home back in Santo Domingo and boasting how she does not need to be here renting from anyone because she has two homes in Santo Domingo one she lives in and one she rents. Yes, and we BVI Landers should be grateful too that we are using the U.S. Dollar because remember, it wasn't always that way and we had to go abroad to other countries to make a living. Let's not take it for granted that everything was this flourishing and easy for us. For people who are honest and work here, I have no problem with. For those who are here to beg, borrow and steal, they need to be sent back and sent out of here ASAP. Except for the criminals who did hard felonious crimes who must be in prison, for the less offenders, instead of jailing and feeding them 3 meals a day, send them out of here.

    What forensic evidence police have.. All the evidence that they talk about, the calls, the cameras there are holes in those evidence...Holes in connecting his actual location at the time of death.. Police need more evidence, they must have DNA placing them together at the time of death.. They must establish the time of death.. if he confess then that's another Story.. But that evidence I see... Was the start of a great investigation.. arrest on suspicion yes... Enough for guilty. No.

        @ Legal Youth. This is so because the pool of jurors seem to be the same set of people they keep choosing (I could be wrong). I always feel that the pool of jurors need to change up. I am not sure how they go about selecting jurors but certainly wouldn't mind sitting on a case. Also, majority of the accused criminals here and jurors selected for cases are either related or have had close family ties. Persons selected to as jurors should be honest when executing their duty. Let their conscience be their guide.

Why all the hiding and secrecy? Alston knew what he stood for and made it known. Some of you man are being unfair to your wives and female companion. They need to make that choice whether they want to live that life or not.
