EXCLUSIVE: ‘Lawbreaking expats will be deported!’ – Ian B. Penn

- Acting CIO promises to do more to ensure that the public is in the know as to what is required of them and of the services the Department provides

ROAD TOWN, Tortola, VI – New acting Chief Immigration Officer (CIO ag) Mr Ian B. Penn said that while he is working to change the negative perceptions of the Immigration Department and to ensure that there is better customer service, he remains steadfast on dealing with foreigners who run afoul of the law and are deemed unfit to remain in the Virgin Islands (VI).

Penn spoke on the issue during an exclusive interview with this news site on December 17, 2014.

Asked whether the Department has seen an increase in the number of deportations over the last year, Penn said that it has generally remained the same, with a margin of error of about one or two.

He said that where a person commits an offense in the Territory, whether against the immigration ordinance or against the criminal code of the BVI and is punishable with three months or more imprisonment, that person is subject or deportation.

“Again cases are looked at on a case by case basis. There are some cases where administratively the Chief Immigration Officer may ask that person to leave the Territory," he said.

Those are mostly where the offenses are committed against the Immigration Act. “The Immigration Officer has the power to ask that person to depart the Territory administratively and depending on the nature of the offence committed, persons could be taken before the Magistrate’s court and prosecuted as well,” he said.

He said if persons are convicted for summary offences or for other offences against the criminal code it is likely that a Deportation Order will be carried out against them.

“Now, I am not a person who people would say I am against any person…I am a people’s person. I love people no matter where they come from. But my philosophy is if you’re going to come to this Territory you’re expected to adhere to all rules and regulations and to conduct yourself in a civil manner. Failing to do so it means that you do not have any respect for the law of the land and as a consequence it means that you are unfit to be in this Territory and as such action will have to be taken to remove you from this Territory,” he said.

However, while there is a strong focus on enforcement, the Department also hopes to improve its education and awareness to the public on the services it offers.

“I think one of the things that is lacking from the Immigration Department is making the public aware of the services that we provide. And that is something that is also on the front burner that I will be getting involved in rather sooner than later,” Penn said.

“There are a lot of people out there who do not understand most of the processes and procedures as it relates to immigration and therefore sometimes they get themselves in difficulties. And only way the public should comply in an effective way is that they know the services which are provided, they understand what they have to do, when to do it and how to do it,” Penn said.

“I think that has been lacking for the longest while and I vow as the new acting Chief Immigration Officer to ensure that our services and procedures are put out there so persons can know what to do, where they have to do it and how they have to do it so as to keep them abreast of their status in the Territory,” he said.

    I concur with you Mr. Penn. If you leave your country to resides in another country then you are expected to be ambassador's of your birth land. I humbly suggest that Mr. Penn should have dialogue with the Commissioner of Police and set up an investigative unit comprising at least four members, twoo immigration officers and two police officers and then start to put the wheel in motion by identifying and sending home offenders whom have breached the Criminal Code and run afoul of the law. If I can come here from Jamaica and be an ambassador then everybody else from which ever country you are from can do the same. Failing to do so send them home.

    All criminal offenses in the Virgin Islands are "Deportable" offenses and it is Mandatory by immigration law to request the deportation of ANY non-belonger convicted in our courts or in any foreign jurisdiction. Immigration on its own cannot DEPORT anyone. The Governor's office does that.

          Of course the CIO can ask people to leave, they do it all the time! The Immigration Ordinance gives the CIO that power. When it comes to deportation because of criminal activity that's when the Governor gets involved.

      It is said that common sense is common but your common sense or lack thereof is an insult. In which country of this world can a birth citizen be deported to? You can deport a man from a country that he's from? So to say the headline insinuates that only non BVI nationals are committing crimes, just need a little common sense on your part to know it have to be non BVI residents.

    Mr, Penn the immigration department do not have the powers do deport anybody, this decision is solely with the governor, i think you are ahead of yourself by saying (will be deported) you do not have that powers boss, check yourself.

    I know a Guyanese man who served about one year in prison and did not even spend a year out of the Territory and is back in the B.V.I. working with a yacht company. All of this happened under your watch. The guy has 2 citizen ship Guyana and Trinidad.

      my 2 cent; i agree with you; i dont know if it is lawful for them to do the time where they are from because the office was committed in the BVI; i will try to sell what they have here in an effort to recover some of the money which was spent on them while at HM Prison...but i am haapy to see penn talking about these presseing issues; we can only hope that penn will now put the "words" into action; we dont need any-more lips servcie on this matter( talk is cheap!!!!)

    its about time; make sure the proper check are done; a number of persons run to the BVI after committing crimes where they are from( we should not allow a person with a criminal record to enter the BVI)..we really need immigration reform here in the BVI..the matter is not about hating or not liking someone from out-side just keep control on all who desire to enter the BVI.....

    Mr.Penn I totally agree with you.So when are you going to get rid of those two police officers who was found guilty of beating the child so badly in Humtun's Ghut.That case was a real shame on those officers who was slap on the wrist with a two thousand fine.

      No body was beaten. where is the medical records. the guy resisted arrest and so the police was within their legal rights to use all means to aPPREHEND HIM. This is the same issue now in the US and none ofthe police officers were indited becuase the victims failed to obey the instructions of the officer.

      this is to bricks and all haters; when a black man in this country or else where has climbed the ladder his own black will do say what ever to see him fall. You never hear this kind of talk with other races as they support each other. Mr, Penn is in the position now and we should all accept it as it is and move on.     It seems like most of you don't realize that being asked to leave and being deported are two different things. Asking someone to leave your house and physically throwing someone out your house; completely different. He said he can ask them to leave. He never said anything about deporting them himself. What a dull bunch..
