ROAD TOWN, Tortola, VI – Isabella Stephens, a national of the Dominican Republic, was placed on $25,000 bail after pleading not guilty to common assault on July 19, 2013 before Senior Magistrate Tamia Richards.

Stephens opted not to retain the services of a lawyer in her trial.

According to the allegations read by Senior Crown Counsel Valston Graham, the Virtual Complainant (VC), Mr Robert Swain, visited the defendant’s place in Sea Cows Bay on December 3, 2011 at round 8:45 P.M. He reportedly went to speak with her regarding a matter that was brought to his attention. An argument reportedly developed between the two and the defendant allegedly took off her slippers and struck the VC on the head and shoulder.

The matter was reported to the Police and two officers reportedly responded. The defendant allegedly admitted striking the defendant and said she did so because he verbally insulted her.

The charge was brought on the basis of a medical report given to the VC.

The court heard that there was significant difficulty in locating the defendant who had subsequently moved from the area to reside at Towers in West End.

Stephens told the court that she is self-employed and works at a bar, has been in the Territory since 1993 and is now a Belonger. She requested a Spanish speaking translator since English is not her first language.

The defendant was instructed not to have any contact with the VC as part of her bail conditions and is expected to return to court on October 8, 2013 for the start of her trial.

It is not she wasting the courts time. It is the system. The case should never have been accepted, and look at the time lag. And what huge bail! Robert you should be ashamed of yourself. Your mum and dad must be turning in their graves over this!
