Damion Morgan accused of choking Police Woman
Morgan pleaded not guilty to the charge of common assault allegedly committed on February 20, 2013.
Abigail Bailey testified that herself and three others including the Virtual Complainant, Ashlee Hodge, Chrystal Mitchell and Desmond Dennis were at Club Diplomat Night Club in Long Bush on the night of the incident. The defendant, Morgan, arrived sometime around 1AM.
According to Bailey, Morgan came over to the group and asked Mitchell to come to him. She left the group and went to have a conversation with Morgan and the two appeared to be in an argument.
Mitchell returned to the group but Bailey allegedly asked to speak with her again and another argument reportedly ensued. Bailey said she did not overhear the conversation as the music was loud at the time.
Morgan later entered the bathroom hallway where Mitchell and Bailey had gone and allegedly pushed Mitchell causing her to fall. Bailey then told the defendant that “all of this is not necessary, [Morgan] needs to relax”. At this point, Morgan allegedly told Bailey to “shut the [expletive] up” before she told him to do the same.
Bailey testified that Morgan then allegedly threw his alcoholic drink in her face and she also threw her drink at him. He then allegedly grabbed her by the back of her neck and pushed her head against a wall, but she put her hands up preventing her head from hitting the wall.
At this point, Bailey said Hodge then came in and Morgan allegedly grabbed her neck and choked her, spinning her around in circles for about five minutes. Hodge later testified that she weighs one hundred and twenty pounds. “I was screaming put her down, put her down,” Bailey told the court.
Dennis and another man reportedly came to Hodge’s rescue and intervened.
Bailey said she was later treated at a hospital for her injuries. A report was also made at the Road Town Police Station. She told the court that she was shocked at the defendant’s behaviour and said, “I didn’t see him as that type of person.”
Hodge, a Police Officer, also offered testimony and corroborated much of what her friend had told the court. She denied being the instigator between herself and the defendant and said she did not hit him repeatedly from behind causing him to choke her.
According to Hodge when she touched Morgan on his arm after seeing him with Bailey, “He turned and grabbed me by my throat with both hands and swing me against the wall, lifting me off the ground. He held me by my throat for five to eight minutes. I didn’t know why or how he let go.”
She also later sought medical attention at the Peebles hospital for neck and throat injuries she said.
The trial continues on May 28, 2014 when the court is expected to hear the testimony of two other witnesses.
