Appeals Court rules against Police Officers found guilty of beating youth

ROAD TOWN, Tortola, VI- The Court of Appeal in the Virgin Islands yesterday, November 23, 2016 upheld a Magistrate’s Court decision that had found interdicted Royal Virgin Islands Police (RVIPF) Officers Constable Marvin Robinson and Wendel Anthony guilty of a police brutality incident– assault causing actual bodily harm.

The two men from the Commonwealth of Dominica and St Vincent respectively were found guilty in 2014 by then Magistrate Velon John of beating Brandon George, a teenager now deceased. The beating incident took place at the teen’s home on June 24, 2012.They were each fined $2,000 to have been paid in two days or spend two years in prison.

Not satisfied with the Magistrate’s decision they moved to the Court of Appeal with the representation of Attorney at Law Hugh Wildman from Jamaica to contest Magistrate John’s decision.

The trial

During the Magistrate’s Court trial the teen never had the opportunity to stand in the court of justice in his defense in the matter since he succumbed to injuries sustained after the motor scooter he was riding collided with a pick-up truck on September 27, 2012.

As it relates to the testimonies given by three other police officers of the RVIPF who were called by the defence, the Magistrate was not convinced they told the truth and referred to their testimonies as being well rehearsed, especially as they had sufficient time to do so perfectly.

During the trial in the Magistrate court it was said that Officer Anthony observed the VC on a bike with no license plates and signaled to him. George reportedly rode off and went to his residence in Huntums Ghut where he later parked his bike.

Shortly afterwards, the VC reportedly heard voices outside and saw Officer Anthony and a friend outside on his stairway. Anthony then allegedly told George to come outside as he was taking the VC’s motorcycle.

It was at this point that the VC reportedly telephoned his mother and related what was happening and made attempts for his mother to speak with Mr Anthony, which proved unsuccessful.

Officer Anthony allegedly repeated his claim of removing the motorcycle when the VC reportedly replied, “You’re not going with any bike.” George also added that he knew his bike was “straight” and reportedly attempted to show Officer Anthony the documents for his bike. Senior Crown Counsel Valston Graham stated that it was further alleged that Anthony knocked the documents out of the VC’s hand.

Officer Robinson subsequently arrived at George’s residence and as he was entering the premises, the VC’s dog in the driveway reportedly started barking at him. Officer Robinson allegedly fired several kicks and stones in the direction of the dog. The VC intervened and attempted to block Robinson from throwing rocks and Robinson allegedly held on to George. A struggle then ensued between the two before Anthony allegedly intervened.

Head-butt

It was further alleged that Anthony hit George in the stomach and chest area and the VC was also head-butted by Anthony who was wearing a helmet at the time; this reportedly caused several injuries to the VC.

A couple of George’s friends were reportedly present and observed as the officers allegedly handcuffed the VC and took him to the Road Town Police Station after which he was taken to Peebles Hospital for medical treatment for the injuries he reportedly received to his head.

Complaints were later made to the Complaints and Disciplinary Division of the RVIPF regarding the treatment of Mr George and investigations were carried out, which resulted in the men being charged.

    The authorities should not let them pay the previous fine since they were so stupid to appeal. Send them straight to jail and then to Dominica and St. Vincent where they belong

    Send them to jail(wishful thinking on my part)..a set of them beating up people then hiding behind the law but thank God the court system works...let see if the commissioner put them back on the force!!!!

    Oh no!!!!! Where is justice??? This is a lesson for all police in the BVI. Do you job you are dammed.. Don't do it you are double dammed. My brothers I am sooooo sorry of the outcome.. hold you head high and don't mind the hypocrite them who will fill up the blogs.. it's officers like you both we need who have reason, discretion, and courage. Not like them who don't know what that means. You will have your jobs back as the precident has been established...

      If you are in-fact a RVIPF officer you should do the work WE pay you to do and stay OFF the blogs! Besides that, they were found GUILTY, they appealed (as is their rights) and they LOST! Now pickup a dictionary and learn to spell P-R-E-C-I-D-E-N-T ~ before you keep misspelling in the damn reports confusing people with your bad language and writing skills.

      I too am disappointed with the outcome because I have seen said young people in action when approached by the police. They are disrespectful and abusive to the officers. Some even threaten the officers. If they are in a group they behave even worst because they believe they have strength in numbers. I have even seen cases where parents would come out and curse the officers when they come to question their family. Officers here in the BVI go through a lot of abuse by the public. If force is needed for compliance, I see nothing wrong with that. I hope these officers were not convicted off the testimony of the other youths who were there...because they are not credible witnesses and would fabricate stories just to get the officers in trouble . I do not believe for one minute this young man was complying with instructions from the officer or behaving in a respectable way.

        @citizen. In the circumstances you outlined, police offices should know what powers they have under the law, if confronted with such situation, they can make notes, walk away, do what the law authorizes them to do and come back. On another note, the young man was in his house, the officers entered his yard illegally and proceeded to take his property, so he have all rights to protect himself and his property, the police officers proceeded to administer blows on him. So Citizen, is this the right approach of someone who supposed to uphold the law. The Officers were dead wrong and the courts proved that they were. Police officers cannot just do what the pleases because they wears a uniform, the law is for them too. If they saw a property in the yard they wanted, they should have do the right thing and get a warrant. You cannot be wrong and still playing strong

        @ citizen: a number of police in this territory wants to walk up on our children and without identifying themselves as police proceed to search them and that is against the law...all police are required to indentify themselves thereafter point out the offence; if such offence is an arrestable offfence the said officier must caution(the suspect) before effecting the arrest( I have personally witnessed police operating contrary to the laws) once the police sees some of us on public road after a certain hour they will exit the police vehicle and automatically begin to search especially black youth; once the youth ask what is going on; some of them are beaten then charge with resisting arrest)...all laws in this territory must be executed lawfully(stop playing bad man mr cop; stop trying to show off on the people of this territory; you come here to uphold the laws not abuse the people)....those on here blogging piss when the police meet your child them beat them up, lets hear from you....

      Policeman do your job and do it fairly, your uniform does not make you high and mighty. They enter the people yard and beat him in his own yard, was that kind of attitude the traits of a police officer who is been paid to protect and serve. Their action was nothing more than foolish. Police have powers but they must also know their limits.

    well my ting is this for each report that comes in on a shift at least one officer needs to wearing body camera it works and help both officer an civilian. it kept my demeanor poise to the point no argument and showed the behavior of other person or can go against officer who has gross the line so I beg of u ranking officers to pls bring back the body cams for officers. lone talking read them their right and charges after no need for no scuffle

    From my observation, there were no overwhelming evidence that these officers beat the boy.
    I even got to understand that the boy bragged about beating the officers.
    Moreover, I have witnessed young men assaulting police officers who approached them in a professional manner.
    Don't get this twisted, I do not agree that if this is true about the officers that it should happen. Police officers are
    supposed to uphold the law too. But let's be honest, we as the public want order on the road, we complain about the scooters, some of them not even licensed and when the officers try to bring some sort of order, this is the outcome.
    Officers do what you can and then go home. Don't bother going the extra mile. Let them roll in them own mud.

    Like i said before if more B.V.I landers develop more National pride.Security and Border patrols jobs should be held by idgenous Virgin Islanders.No where in the Cairbbean can Virgin Islanders go In Any Caribbean country and take up government jobs and the same should be done here in the virgin islanders.

We already see how much nepotism here and the corruption it breeding. How the hell will the bad elements get arrested by locals if it's our families doing the crime?
      You people are so dam wicked and love to see others fall. They were protecting our island from ourselves.. Whilst you and others were busy in gossip and world domination.

I have inside information about the cops misconduct, All I am saying to cops, do your job without violating citizens right. Our cops should not be like the trigger happy cops in the USA. No hard feelings vs Cops. I am for wedding out the bad guys - Born here or there.
