Andre Penn to serve 10 years for sexually assaulting girl

ROAD TOWN, Tortola, VI - ‎When Justice Darshan Ramdhani today February 17, 2015 announced his decision in the High Court to the point of imposing a total of 15 years of imprisonment on former legislator Andre Penn some felt a bit vindicated but it all turned sour when he announced his decision which saw the time reducing by five years.

On the seven counts of indecent assault the Judge imposed a 3-year sentence each, on the one count of unlawful sexual intercourse with girl under 13 years he got 8 years and on the two counts of buggery 4 years each.

The judge then ordered that the three categories of the sentences run concurrently which put the total years to 15 years.

The bitter news to the young girl who is now 17 years old, her caregivers and others concerned was when the Judge stated that in law he had to consider the number of years the trial hung over the head of the defendant, Penn, and as such he ‎reduced the time to be spent by 5 years. One year was deducted from the combined seven indecent assault sentences, three years removed from the unlawful sexual intercourse against a girl under 13 years sentence and one year was removed from the combined two buggery sentences.

Once out of the courtroom the pain could have been clearly seen on the face of the now 17 year old as she repeatedly questioned her present day caregivers "Why?" while others could not contain themselves as they made several utterances.

Those included, "Penn get away with murder," "Look how they (Penn’s relatives) smiling," "this trial needed Albert Redhead," "The law don't have a clue what this child lives with and will for the rest of her life," just to mention a few.

The judge's sentences are to take into consideration the time Penn has already spent on remand.

    The number of years the trial stood over the head of the defendant was due to his own doing -- filing papers and playing lawyer and dodging from the court and he got credit for that? Nonsense. Don't worry, my dear, God is above, karma is still operational, time longer than twine, and what you sow you will reap. Every dog has its day, Andre Penn hasn't seen his day yet.

      Yes, God is above! Not just for him, Penn, but for a lot of other wicked evil doers. One does not need to do a thing but step to the side, pray and watch God in action!!

    No justice was served. Why did the judge discount the sentence when Andre Penn was the delayer of the trial? Them look like somebody was cooking a pot and passed the buck, man. This is advantage can't done. We will ask all the Catholic people in the region to pray that higher justice be meted out.

    Andre boy take my advise don`t waste your money and your time with appealing, you will be out in 18 months for good behavior. you will be the prison teacher, law, English, etc. yea---for real. People will be outside working hard behind the scene for you to be release early.

    I don't get it. 10 years or 15 years, what difference is it going to make in terms of what already happened to the victim. It's not like he was suppose to get life in jail and only got 10 years. I know if I got 10 years In jail I would go mad.

    I read on another site that this guys lawyer asked the Judge to take into consideration that the minor gave her t consent which the judge couldn't believe. I want to pule because his family has been making it sound like he was set up when he actually was guilty all along. Thank God that God is still merciful and I pray that the young lady can find peace and ultimate forgiveness and be set completely free from this horror regardless of where this monster is. On the flip side I pray that he had gotten down on his knees and ask God and this child for forgiveness. Lord have mercy on him and all of our kids because they're not safe anywhere and with anyone.

      East End, you sick to be saying that JJ is need not be in jail. The rule of law states that "no man is above the law, and all subject to it." How dare you come on here and say that the offences set up by the Criminal Code to guide this society is not applicable to the so-called good man, JJ? It is statements and beliefs like yours that will continue to lend encouragement to many other molesters to bud more of his behavior. Yes, JJ needs to be in jail. He did the crime; let him do the time and see if he can benefit from one of the objects of sentencing -- maybe rehabilitation.

    This is a quote from BVI News.

    As he summed up the case, Justice Ramdhani took issue with a suggestion made by Penn’s attorney, Jerome Lynch (QC). The defence lawyer had told the court to consider as a mitigating factor, evidence that the female minor consented in some instances – though not legally."

    So the court should consider that the minor consented in "some instances"- so he was going on the girl all the time. That's a child, regardless of anything. You are the man here and you shouldn't even let a child see you in your vest much less. Respect yourself man

      I was thinking the same thing. Look at the quote of the article above where he actually want the Judge to consider that the girl consented to some of the instances. Yes, you stand by your man and prove your commitment to a marriage, but this is beast style. How can she sleep next to this man. She is either blind, dum or a desperate moo moo. The first wife would have buried him for sure cause she don't play.

It was a child..A CHILD, who should have been loved and protected to experience all of the joys of a childhood before they have to be thrust into the adult world to worry about adult things. At 13 she should would have been experiencing many first in her life and one of them was not suppose to be intercourse and intercourse on so grotesque a level - my god man!
