Alberto Rosa De La Rosa guilty of manslaughter

ROAD TOWN, Tortola, VI - "Guilty as charged" was the unanimous verdict of the jury body in the manslaughter High Court trial of accused ‎Alberto Rosa De La Rosa aka Pi Yoyo‎.

The decision came today October 16, 2015 in the High Court of the Virgin Islands. ‎De La Rosa is to return to court for sentencing hearing on November 27, 2015 when the Crown will submit a victim impact report. Attorney at Law Patrick Thompson has also requested that a prison impact report be submitted on behalf of his client.

The decision was handed down after days of trial where the crown represented by Senior Crown Counsels Valston Graham and Leslie Ann Faulkner called a number of witnesses, some police officers and other persons who were on the scene of the night of November 16, 2012 when Riky Bautista Familia aka Macoticea had his life cut short with a single stab wound to the chest.

The incident took place at a Bar popularly known as Maria's Bar in Sea Cow's Bay.

During the course of the trial several witnesses testified to having seen a fight between the two which was started by the now deceased ‎man. The court heard of an exchange of words between the two where De La Rosa, during a heated exchange brandished a knife at Familia, who in return dared him to use it.

Familia who was made out to be the aggressor, according to witnesses had grabbed a bottle and pelted it at De La Rosa. Another testified to having seen the accused 'juk' Familia while another told the court of seeing the accused with lots of blood about his face and hand while with a knife in his hand.

The owner of the bar testified to having given De La Rosa a complimentary shot of Brugal rum that night. She told the court of hearing a big squall in her bar as she was in the music cabin changing the music. She recalled that in the heat of everything she attempted to call the police but ended up calling 119 instead of 911. She also recalled ordering the doors of the bar shut when most persons had run out but remembered De La Rosa breaking open the front door and re-entering the bar.

Many photographic exhibits also formed part of the trial and it was during the testimony of Police Officer Washington two knives were exhibited as having been found on the scene, one with a handle and the other without.

De La Rosa had made his first appearance in the Magistrates’ Court of the Virgin Islands on July 11, 2014 before Magistrate Ayana Baptiste-DaBreo following his extradition from the United States.

      12 to15 years at least and at taxpayers expense for his free room and board at upwards of $30,000 per year. In all those years nothing will be required of him. Another one who came here to "build up the VI'. How much has he given back to the VI to date and he is now a locked up smoocher. Criminals such as these should be made to spend their time in a real prison off Island. His homeland comes to mind.

        What kind of punishment is it really, if they send him home? Why would DR take on BVI sentencing and they are not of the same nation? Being in prison here is not as simple as you make it to be. He don't have the freedom to go and come as he likes, he don't have the freedom of doing the things he loves to do, he don't have the freedom to go see his parents and his family in DR like he did every Christmas. Losing all those opportunities and the many others not mentioned is indeed punishment which he deserves. Sending him back to DR he will be a free man, free to live his life in his country inhis home, which is no kind of punishment but rather a reward.

          The blogger indicates that justice would be better served if he spent time in a Santo Doming prison and not the country Club' of the BVI. Keep in mind that prison is not for punishment but for rehab. A real prison would be just the place for this. The punishment is being imposed on the BVI and its people. He is here because of the crime in his country which has stunted their economy. So , in fact a punishment, undeserved ,is being metered on a country and its people that opened their shores to this man and too many others like him.
          The BVI should have an agreement with these places regarding their human exports unless we opt to do what is in our best interes and close our shores or impose a moratorium on some countries.

          No worry for him about NHI. We will pay his share and med care will be available to him whenever he needs it along with breakfast lunch dinner snacks telephone internet Tv cleana bed and a roof over his head.

    just send the man from the territory: to feed him for 12 years is a waste of tax money.... alert the lawful authorities in Dominican republic and send him home......

      Hell No! He did the crime here so make him do the time here, this way we are guaranteed he will pay for his EVIL DEED. This low life should have gotten LIFE since he took a life. Hope he has a hell of a time in prison too.

      Provoked or not. He had NO right to kill Ricki. He could/should have walked away and report the incident to police.
