ROAD TOWN, Tortola, VI- Local attorney Richard G. Rowe has pointed to the double standard and insularity regarding the condemnation of former Premier Andrew A. Fahie (R1) and others by persons in the Virgin Islands.

According to Mr Rowe, persons were willing to give a free pass to the United Kingdom (UK) lawyers working in the Virgin Islands (VI) for the Commission of Inquiry (CoI) without being called to the bar and not having a work permit.

Hon Fahie was arrested on April 28, 2022, in Miami on drug and money laundering charges based on an affidavits by an undercover Drug Enforcement Administration (DEA) agent.

He has since been stripped of his title of Premier.

Never seen a parent abandon her child on criminal charges- Rowe

“We have a premier, an ex-premier, who is charged for alleged offences, and it appears certainly, contrary to the rule of law, that we have all found him guilty already without having heard a word from him,” Mr Rowe pointed out while a guest of the radio show PSI TV with host Kenneth G. Gladstone on May 16, 2022.

Mr Rowe added that he has been practising law since 1979, mainly in the criminal courts, and he can’t recall any mother who has abandoned her child because that child was charged with a criminal offence.

“But here we are, purportedly under the rule of law, on the basis of solely an affidavits of an informant.”

Who to trust?

Meanwhile, Mr Rowe says he views even the DEA with “great suspicion’ due to past experiences.

According to the veteran attorney, he was approached by DEA agents while practicing law in Jamaica who asked him to represent certain alleged drug dealers on the condition that “they [DEA agents] must receive a part of my pay and that I cannot exercise all the rights for that person charged. In other words, they must be found guilty.”

Staff of Premier’s Office ‘condemned as criminals’

He said similarly he has noted that staff of the Premier’s Office, particularly the Permanent Secretary, have already been condemned as criminals.

Governor John J. Rankin, CMG announced on May 12, 2022, that a criminal investigation into the conduct of the Premier’s Office has been launched.

He said the investigation was launched over the alleged obstruction of the Director of the Internal Audit Department in respect of her audit of the COVID-19 Assistance Programmes, as stated in the Commission of Inquiry (CoI) Report.

As a result, the Permanent Secretary was sent on leave.

“So I look with great suspicion…when anyone under the pay of an agency will make allegations which are yet to be proved as true that we have, under this rule of law, condemned his office and his staff, the Permanent Secretary, as if she is a criminal, to a criminal investigation and put on leave when it is not a crime,” Mr Rowe said.

He also opined that the CoI report has "overtly painted" local leaders like Myron V. Walwyn and Hon Julian Fraser RA (R3), as criminals.

Based on the recommendation of the CoI Report, the Governor has instructed criminal investigations into the ESHS Wall Project, which was done during the tenure of former Education Minister Mr Walwyn and the Sea Cows Bay Harbour Project, which was during the tenure of former Works Minister Hon Fraser.

According to Mr Rowe, the evidence so far, which includes engineering documents, shows there was no criminality involved in the projects.

Double-standards?

Meanwhile, three CoI Lawyers were accused of practicing law in the Virgin Islands (VI) for some five months before filing an application to be called to be the BVI Bar. 

Attorney General, Hon Dawn J. Smith has said, “the law is clear,” and that the three lawyers “should be admitted to practice in the VI if they are to perform duties as counsel and solicitors to the CoI established under the Commission of Inquiry Act.”

On November 22, 2021; however, the United Kingdom House of Commons sought to shield the Commissioner of Inquiry (CoI) Attorneys, the Commissioner himself and the local Governor John J. Rankin, CMG from paying any legal fees out of pocket if they are sued over the CoI.

In the VI, some residents staged a small protest claiming that the then Speaker Julian Willock must pay out of pocket as a British Judge Adrian Jack ordered amidst controversy.

Mr Willock had filed an injunction against the CoI lawyers but subsequently discontinued it.

    Me Rowe congrats you passed the test! The alleged DEA agents who approached you were probably set up to test whether you were a corrupt lawyer in the Jamaican Criminal System. Have you ever given this any thought? The fact that you did not fall prey to the alleged plot proved that you were not corrupt. The former Premier had the same choice walk away and blow the whistle. or accept. Instead, he choose to participate in an alleged criminal act. Whether he is found guilty or not, this act has ruined his life and tarnished the face of this territory. He was tried, tested, and found wanting. He is now awaiting to be weighed in the balance.

        Let's get educated about the difference between Entrapment and a Sting Operation.

        What is a Sting?

        By all accounts, a sting is an admittedly deceptive practice used to catch those involved in criminal activity. In a sting operation, a police officer—usually undercover—or a recruited civilian is typically employed to facilitate the suspect’s attempts to commit an illegal act. This often includes a law enforcement agent posing as a prostitute, drug buyer, or one of many other potential roles. When the suspect attempts to commit the illegal act, he or she is usually arrested and charged.

        Understanding Entrapment

        In a very real way, a well-orchestrated sting operation is perilously close to entrapment. Entrapment, by its definition, refers to a situation in which the suspect was not only lured into committing an illegal act by a law enforcement officer—again, usually undercover—but would have otherwise never committed such an act if it had not been for the participation of the officer. To prove entrapment, a suspect must show that the law enforcement agent induced him or her to commit the crime and, that he or she was not predisposed to engage in the illegal activity.

        The main difference between entrapment and a lawful sting operation is that a sting operation offers an individual the opportunity to commit a crime while entrapment involves the individual being coerced or persuaded into committing a crime.

    Dear Mr. Rowe,

    Respectfully, please go shut your ...... and take several seats.

    Tell the story correctly, if you must. Note for the record that it was the AG who upon the inquiry of the Commissioner Hickenbottom, confirmed that it was not in fact required for the lawyers from the UK to be admitted to the bar in the BVI because this matter of the COI was not a matter of practicing law. And that confirmation was given on the arrival of said lawyers to the BVI and not when the issue was raised by you and your colleagues in defense of the government. Get it right and tell it right.

    Now that the Report has been laid and the charges and investigations into the highlighted wrong doings are on the way, ANY lawyer defending a case in connection with said charges will have to be admitted to the bar because now they will be practicing law.

    You have a problem? Go take it up with the AG.

    Furthermore, note that these two things which you are insisting must be compared are in no way comparable and as it turns out we needed the COI to ensure that all these matters came to light.

    The issue as I see it, is that we are conflating two issues, the fate of one Mr. Fahie and the fate of the BVI and from where I stand the BVI cannot, should not and will not go down in a blaze of fire for the defense of one man, who by his actions did not have our best interest at heart. AT NO TIME!! Everything he did was for his OWN selfish purpose! And when something start wrong, it cannot go right. Greed Sir was at the heart of his demise and it started when he attained the power to act upon that greed.

      @DOWN ISLAND. why don't you speak unbiased truth? Yes there are negative experience by expats here but tell me where that doesnt happen? This spin goes both ways a lot need to look deep inside themselves and redeem that positive self. As an expat you have options, real options to choose where to live, what to tolerate, what to do with your life. And life is real. Self preservation comes first. I lived in a foreign country before and I met good, bad, ugly and otherwise. All real. You have a kitchen to cleaning as well. Get busy.

    So what do u expect his to say or do?
    By the way, is AF a naturalized US citizen, or a green card holder? Just wonder why his US SS # was published in his 2003 US court allegations? It was in those court documents circulating since his arrest. Who saw them?

    If it was just the Miami arrest alone, Mr Rowe, I would agree with you. It would just be 50/50 against him. But when you look at it in the context of the separate and unrelated COI findings, then that is something else. Especially when you add in the Navy Ship/Radar Barge fiasco. Remember, Gus specifically said he suspected (maybe Gus knew) that drug activity was happening.

    Are you disputing the official COI findings, Mr. Rowe?

    So let's throw in the rest of the COI and the attempts to obstruct it (as you well know), then it looks a lot closer to 100/0 against him.

    I agree with Attorney Rowe 1000%! What ever happened to "innocent until proven guilty"? The former Premier has been tried, convicted and condemned based on an affidavit by a DEA agent! His word alone! He said he has audio and video. Where? His affidavit surfaced for the world to peruse, but no audio, no video. Yet, we believe every single word he wrote! Who is he? Jesus the Christ?

    Anyone arrested on the charges that Fahie faces is probably best served by keeping their mouth closed. I’d imagine his attorney told him that, so no wonder he hasn’t said anything.
