PARAQUITA BAY, Tortola, VI – Opposition Member, Hon Carvin Malone (VI) has reiterated his calls for the United Kingdom (UK) to withdraw without delay, the Order in Council being held in reserve to suspend the [British] Virgin Islands constitution.

This comes as regional bodies including the Organization of Eastern Caribbean State (OECS) has called for the removal of the order, including that it objects to the imposition of direct colonial rule over the people of the VI.

Hon Malone during a short speech during an the Educational and Constitution Forum on the review of the VI Constitution held at the Eileen L. Parsons Auditorium of the H. Lavitiy Stoutt Community College (HLSCC) on Thursday, December 8, 2022, said the order remaining in place, is criminal.

Order in Council 'criminal & disingenuous' - Hon Malone 

“It is criminal, disingenuous. Not right that we have this order in Council, that is a live document, sitting on the dressing table of someone who has the single power to put it into effect. If they feel that any of the remaining 48 items are not adhered to.”

Suspension of the Virgin Islands Constitution was the overarching recommendation of the lone Commission of Inquiry (CoI) Commissioner Sir Gary R. Hickinbottom as part of 50 CoI recommendations. 

While the UK has not suspended the constitution following activism against direct rule on the local, regional and international front, the former Minister for Overseas Territories and former UK Prime Minister Mary Elizabeth Truss instituted the Order in Council in the UK Parliament to be held in reserve. 

The Order essentially gives the Governor the power to suspend the constitution at his discretion, should the Unity Government not carry out CoI reforms according to an agreed framework between the UK and VI.

“It is criminal… that we are on the eve of a General Election and not knowing whether we have one, because of this very same order in Council,” he added.

Gov't agrees to removal of order 

Hon Malone said that remains unjust that the VI can have an election, choose a new government and still have the order in Council hovering with the possibility of it being enforced the month after the elections.

While the Government of the Virgin Islands agrees that reform is needed and has committed to its implementation, it has also objected to the Order in Council, with Premier Natalio D. Wheatley (R7) also calling for its removal. 

Many have described the order as the UK holding a gun to the VI’s head to carry out reforms, which is not symbolic of a modern partnership as proposed by the UK to its OTs.

    You begin to realize what's going on,, there is no interest in having an election .Seems like you seeing what I'm seeing, there will be no election, the constitution will be suspended for two years to give the recommendation time for satisfactory completion and most of the unity govt members will be retained as administrators..

    Relax your mind Hon. Carvin Malone. Politically speaking, the UK is in the driver's seat. Let justice have its course. Don't act like you don't know why a CoI probed was necessary to exposed unaccountability or mismanagement of our finances over many years of our finances by most politicians.
    Whatever hammer, politically speaking is held over our heads in reference to our Constitution suspension, we are more to be blamed than the UK government.
    I hope that the UK will see no need to suspend our Constitution, but rather help us in its reformation for the sole of better governance for all the citizens of the British Virgin Islands.

    I am not sure why he should "relax" there is precedent here so I believe the Hon.Calvin is prescient in sounding the alarm. Those that fail to learn from history are doomed to repeat it. The fact that he is being pro active demonstrates that he is the leader that we need, a critical thinker that can navigate the political landscape and develop meaningful solutions. Practical experience ( political and Business) to prepare and Lead the BVI to future Hon Calvin for Premier.

    Honourable Malone, at this juncture we need the UK to come. There has been too much injustice administered to BVI landers over the years by leaders, permanent secretaries, heads of departments, directors et al. People are going about from day to day carrying the pain, the scars and the hurts. An election to put in the same persons who created havoc for people in the past would be (colloquial) 'taking stick and digging in your sore foot.'

    This place needs healing. A new election would not solve anything.

    We are a bunch of political cowards. The UK should not be able to suspend our constitution. If they can it would mean the UN charter on the right to self-determination is a hoax. They are hoping that we'll succumb to their threat without a fight. Don't acquiesce fight for our rights to self-determination if need be we should go independent. It's independence or integration. Integrating will put us at the bottom of the UK's hierarchal system, and independence will give us an opportunity to form our own country.
