PASEA ESTATE, Tortola, VI- The Andrew Fahie-led regime is making strides to modernise the territory’s existing Labour Code 2010, to bring it “more in line with the current VI labour market and industry standards.”

This was one of the decisions coming out of the March 17, 2021, Cabinet meeting chaired by His Excellency, the Governor Mr John J. Rankin, CMG.

The meeting was held at the Financial Services Commission’s Conference Room where all members of Cabinet were present.

Michele Tiraboschi to be hired as consultant

The Cabinet Decisions released on the Government’s website on Thursday, March 25, 2021, stated that Cabinet “decided that the Government engage Mr Michele Tiraboschi, as a consultant, to work on a collaborative basis with the Attorney General’s Chambers to undertake the review of the Labour Code, 2010.”

Local government also agreed to pay Mr Tiraboschi, $24,000 for the consultancy, which took effect on March 24, 2021.

According to our research, Mr Tiraboschi is a Full Professor of Labour Law at the University of Modena and Reggio Emilia, Italy, and is the author of many publications. He is known for his participation in national debates on Italian labour market reforms and for his research in labour law.

‘Simplified’ Labour Code

The consultancy also requires Mr Tiraboschi to provide the Ministry of Natural Resources, Labour and Immigration with a draft revised and simplified Labour Code for the Virgin Islands; a draft Labour Regulations for construction and marine Industries; and finally, a National Organisation Health and Safety regulation according to the International Labour Organisation standards.

Another decision was also made relating to waiving work permit for consultants like Mr Tiraboschi, the document stated.

“Decided that Part X (Work Permits) of the Labour Code, 2010 shall not apply to consultants engaged by the Government of the Virgin Islands and statutory bodies established by it for the duration of their engagement in the Virgin Islands.”

    Please, Please, in this revision Plese consider adding to the code " No Lay off during a Disaster" Give emoyers the Authority to Cut hours to a minimum 20 hrs a week for weelly workers or half salary for Salary workers for a period not excreding 10 weeks, as an option to redundacy, Becaue los of tbese employers used disaster as an excuse to cut staff....

    Typical BVI! New Labour Code passed 10 years ago and only abou 40% of it being enforced and now we are going to spend another set of money messing around, only to ignore half of it. Spend the money to furnish the schools and get the kids back out instead of wasting it on bu*****t.

    Let's hope that their revisions are not done in a vacuum and that they learn that consultation with the industry and with employees should factor into the decision making. But as an aside....how many things are these guys and ladies going to try to change in a few years. why cant there be a focus on getting a few things done to completion rather than bits and pieces everywhere with no definitive end and completion to projects?

    The Italian law cared for the citizen , just imagine that the pregnant wife can stay at home and the husband too and still get paid for six months to a year. However their taxes is more than fifty percent.

    Now, image that minimum wage should be worded as "Living Wage" and raised to match that of 15$ and working hours would be 48 hours per week and every six day is a day off. It should then covers terms and condition to include discrimination, termination of employment ( must be done swiftly with the employee leaving with their correct amount on the check in hand ) industrial relations, maternity and family leave rights and business sales.

    Response to severance paid, should be done immediately, and enforcement of law to the employers who do not pay their employee taxes but deducted from their salary should be forthwith, if that employee is no longer in their employ.

    Training for BVI islanders and belongers should happen when a position become available so that they are empowered to development the business and their country. Another is protecting business data, practice and procedures.
