US quartet charged with Illegal Entry pleads guilty in court; Fined $1000 each

ROAD TOWN, Tortola, VI- The United States quartet – Nicholas Cancro, John Hines Jr, Lynee Ann Hines and Jeanne McKinnon – who were all jointly charged with the offence of landing in the territory without the leave of an immigration Officer on November 19, 2020, initially intended to challenge the matter but opted to plead guilty after hearing they would spend the holidays behind bars on remand instead.

John Hines is 68, a retired navy veteran, his wife, Lynne Ann is a former health instructor, McKinnon is a retired teacher residing in Puerto Rico, and Cancro is a 71-year-old retired electrical engineer.

They all pleaded guilty to the offence when they appeared virtually before Magistrate Christilyn Benjamin on Monday, December 1, 2020, and were fined $1,000 each or spend two months in prison if unable to pay.

Facts

According to Crown Counsel Kristain Johnson, the Joint Agency Task Force at about 1.30 pm on the day in question, received information of a sailing vessel travelling towards Jost van Dyke from St John, USVI.

As a result, the team proceeded towards the western side of Jost van Dyke and spotted the blue boat in the vicinity of Sopher’s Hole travelling in an easterly direction.

The vessel, skippered by Cancro with the three as passengers on board, was located at 18’ 23.885N 064’ 44.041W, which is in the Territorial waters of the Virgin Islands, the court heard.

'Just sailing around'

The court heard that when Cancro was questioned about being in the territorial waters, he reportedly said: “We came from St John, USVI and was just sailing around.”

Cancro then said he was aware that the borders were closed but, “we didn’t touch land.”   

The quartet was then escorted to West End and later placed into quarantine at a local hotel.

They were eventually charged with the offence before the court.

Bail

Meanwhile, Attorney David A. Penn, who represented the defendants, made an unsuccessful bail application on their behalf to the court.

Penn said he was hoping that the court would grant his client reasonable bail that they could leave the jurisdiction and return in person or virtually to attend the trial.

However, the Crown objected to bail, stating that the defendants were a flight risk and they had no links or status in the Virgin Islands and there was a high chance that they would not return for their matter.

The court agreed and was setting the trial date early in January 2021 before court officially reopened.

However, due to the prospect of spending over a month at Her Majesty’s Prison, they all admitted their guilt and were sentenced right away.

    Take these people faces down every time I see them it makes me sick. they were wrong and I don't put it past them to rip the sink off the wall to make the BVI look bad you are dealing with some low bad minded people.

    The people who have been coming to the BVI for years know that we are not like that. People you can't be wrong and strong.

    The BVI is a laughing stock and embarrassment. Why would you mess up large part of your economy like that? Virgin Gorda is the Tourist Hub of the BVI. Why would the Representative of Virgin Gorda just sat back and allow this to happen?

      Wishful thinking on your part.. a few pieces of made in America trash cannot disaffect economies. American passports carriers are nondesirables and are least tolerated.BVI is renowned as a result of nonamerican classes of travelers and continue to be that way and mainly because it is nonamerican. A Caribbean Island vacation with none fo few Americans is precisely why many travelers ,myself and family included bypass the USVI.

    Amazing how the task force could have spotted a boat in Sopher's Hole from the "western side of Jost van Dyke". Would have been a lot easier to see and monitor from Eastern end of JVD. Ya'll the best!!!!

    Yall see how some of these commentators think.. our government has us so dependant on tourist money that we should be grateful and allow any bad behavior to slide. because that is what they think we a worth. and when they don't get their way their allies on fb and on this same site jump to make threats because they know they hitting where it hurts. no matter how much some of them smile and laugh with us they thinking that we aint more than bus boys and waiters...... wake up!!!!!

      They are ignorant to any and all. They have no clue. Most of them have never met a local BVIslander. Unlikely to meet a local at their hotel or restaurant or bars since locals are most likely the proprietors.

    All over the US this has looked very badly for the way the bvi handled this. I understand they strayed over the line but $20k...this news has not gone down well. A simple heavy handed reprimand and maybe a deep search of the boat to show a serious approach would of been suffice. Instead it’s looked as a detain and ransom. Could of been handled much better...gobsmacked

      These people aren't telling the truth! They did more than just stray over the border... They were in the territory for THREE WHOLE DAYS!!! There is more to this story than you know. Besides, you think that it would be ok if it was the other way around? How many persons have the US Coast Guard detained and deported for "straying over the border"? The captain also admitted that they knew they were in BVI waters and that the borders were closed but thought it was ok! How stupid can one get??? They deserve to get whatever they get coming to them.

    The BVI government needs to build a border buoy system along the 'imaginary' border between the USVI and the BVI to prevent future 'illegal entry' problems. The lighted border buoys should be at one half nautical mile intervals from the north drop west of Tobago then through the Narrows to east of Flanagan Island then to the south drop.

    there have been a double standard for so many years in this place/caribbean descendent are subject to one system while descendants of our former slave masters are given red carpet/a yew back a national of this territory was sent to HMP for breaching the entry laws/here we have non nationals payment of a few pennies in violation of same entry regulations/the man born right here went to the jail house for unlawful entry (play the tape)......what our system wont do for the sake of a dollar especially when it comes to dealing with sons & daughters of former indentured masters(how sweet it is !!!'

    These people knew the rules but thought they would get away with breaking them. White Americans think they are entitled to so what ever they want and get away with it. They should be held in jail like all the other people who break the rules. The government is doing something f eight finally by trying to protect its people. I say lock them up, all four of them.

      Locking up tourists for an honest mistake is bad business for a country dependent on tourism. In case y'all didn't notice global travel is screwed and it's going to be a loooooong time before the economy recovers. Sure, give them a wrist slap and fine then let them go on their way. Throwing tourists in jail for an inadvertent violation is an excellent way to hurt the local economy and local people (or the ones who want jobs).
