UPDATE: Mechanic pleads not guilty to criminal trespass
While the defendant said he had discussions with an attorney, he explained that no payment had been made and this meant that he would still require additional time to secure representation before he could make a plea.
Instead, Senior Magistrate Tamia Richards told the defendant that he could not continue to delay the court before he offered a plea while he sought to get an attorney.
He was asked whether he would be able to offer a plea and stated no before eventually conceding and offering a plea of not guilty to criminal trespass.
Prosecutor Herbert Potter said the Crown’s file is ready with the exception of a transcript for the defendant’s audio interview.
The trial date was then set for September 3, 2013.

ROAD TOWN, Tortola, VI – Sydney Varlack-Malone, 57, of Fat Hogs Bay allegedly told officers he had no intention of stealing when he allegedly trespassed on someone’s property in the vicinity of Slaney Hill, but rather was only interested in sex at the time.
The defendant, who is a mechanic by trade, was not asked to offer a plea to the charge of criminal trespass when he appeared before the Magistrate’s Court yesterday, May 23, 2013 since he told Senior Magistrate Tamia Richards that he planned to secure an attorney for his case.
Police alleged that the Virtual Complainants were at home when they observed a person wearing a blue long sleeved shirt, grey hat, and socks on their hands, among other items, entering their premises.
It was further alleged that the defendant ran away on noticing he was being observed. Police later visited the area and the same person fitting the description given by the Complainants was discovered walking along Slaney Public road.
The defendant was allegedly seen hiding behind a jeep upon sighting the police in the area. The court was further told that Police informed the accused of the allegations against him and told him that it was an offence to trespass on private property.
The defendant allegedly replied, “I aint went there to thief, I only went for sex.”
He was then arrested on suspicion of criminal trespass, charged and granted police bail.
Varlack-Malone was granted $75,000 bail in the Magistrate’s Court and ordered to have no contact with the complainants. He will return to court on June 14, 2013.

is it against the law in the BVI for somoeone to have or seek sex? No joke, just is this so? Seems
like the stupidist penny anti events get someone charged and arrested and detained like a real hard core
criminal over jack sh#$. What exactly is the truth in these events? Should you warn outsiders who may
respectfully pay the BVI a visit, that anything that could be 'intimate' is against the law? Tell us all.
And why was someone charged with a crime for 'stealing coconuts out of some ladies' yard? WHAT??!!
