UPDATE: Gun, cash allegedly found at home of man accused of staging robbery
Magloire is accused of conspiring with others to stage the robbery executed in the RiteWay Food Markets parking lot at Road Reef Plaza on the morning of October 13, 2013.
He was denied bail on October 22, 2013.
According to police and others close to the investigation, sometime on Friday afternoon, October 25, 2013 officers from the RVIPF conducted a search of Mr Magloire’s home where the discovery was allegedly made.
The recovered cash is believed to be portion of Mr Magloire’s taking from the alleged robbery deal.
Further investigations are continuing.

Driver accused of staging robbery mum on alleged accomplices

A driver who has been accused of conspiring with others to stage the robbery which was executed in the Riteway Food Markets parking lot at Road Reef Plaza on the morning of October 13, 2013 is refusing to give police the names of two other persons allegedly involved.
Patrick Magloire, 51, was placed before the Magistrate's Court on October 22, 2013 on the charge of conspiracy to commit robbery and was denied bail.
The accused is said to be a Dominica national who lives in Nottingham Estate.
The court was told that the men conspired to commit the daring robbery sometime between October 10 and October 13, 2013.
An undisclosed sum of money, along with other valuables, was allegedly stolen.
Retail Manager of RiteWay Food Markets, Mr Andy Clayton, had told Virgin Islands News Online that the robbery occurred just around 9 A.M. in the parking lot of the supermarket while the driver was sitting in one of the company’s vehicles.
“[He] was approached by what seems to be a masked man who tried to take control of the vehicle,” Clayton had related.
The man eventually succeeded in taking the vehicle along with a quantity of cash. Clayton had declined to give an estimate of the cash stolen at this point.
The Retail Manager had further related that although some force was used to commandeer the vehicle, there were no reports of a weapon being involved in the incident.
He further told this news site that one of the employees, who was nearby, jumped in his vehicle and gave chase but lost sight of the vehicle shortly afterwards as it headed towards Road Town.
The driver, Mr Magloire, was reportedly said to have been very traumatised by the incident which was allegedly reported immediately afterwards to the Road Town Police Station. Several witnesses reportedly saw the incident as it unfolded.
According to reports, the vehicle was abandoned at McNamara.
Magloire, according to police, confessed to staging the robbery during an audio/visual interview.
He has, however, allegedly refused to disclose the names of the other persons involved.
The defendant has been ordered to return to court on November 22, 2013.

In the interest of the public,I would like to express my thankful gratitude to the brave royal police officers of Her Majesty's Police Force,for their continued dedication to serve and protect the citizens and residents of this blessed and beautiful territory,and bringing this case to closure and let me thank His Excellency,the Governor and his office,for his constitutional role,to assent to laws on behalf of Her Majesty,and to allow these laws to be enforced by the police and other lawful authorities under our justice system,in its criminal jurisdiction,in this free and democratic BVI;as section 16 of the V.I Constitution,declares that a person is innocent until proved guilty by a competent court,after a hearing by a fair and impartial court,established under BVI laws.
I wish to sympathise with the management and staff of RiteWay for their lost,of their hard earned money and I do hope that justice will be done under the provisions of section 16 of the V.I Constitution with a proper prosecution of this heinous crime against Her Majesty's Laws:
And let me ask the DPP and his hard-working competent staff a legal question on a point of law.
I recognised that the DPP has the constitutional authority to prosecute and to determine that the facts [without oath] presented to him by the police are consistent with a criminal offence under BVI laws before he commences a criminal prosecution:
This democratic news site reported to the BVI and the world and I read it as written,that the accused was charged for "Conspiring with others/conspiracy to Rob" and the facts declared that a staged ROBBERY took place and no other Robbers were detained and charged by the police:In other words'there was no robbery'
However,the accused who confessed under section 84 of the BVI Evidence Act,did not name his accomplices:He gave a "story" of a "Robbery"!
In the interest of the public and justice for all,I am still lost! Because the definition of theft in the BVI Criminal Code,1997,seems to have been overlooked:
The Law-on theft-Section 203 of the BVI Criminal Code,Defines the offence of "Theft"-
" A person is guilty of THEFT if he/she dishonestly appropriate property belonging to another with the intention of permanently depriving the other of it[the property] and thief and steal shall be construed accordingly".
So please help me to define the term "Conspiracy to rob" when the "staged-victim" who was allegedly robbed,but was never robbed,has now been identified,as an accused,but not a victim of a crime/robbery.
Section 210 of the BVI Criminal Code defines Robbery:
""A person is guilty of robbery if he steals and [immediately before or at the time of doing so,and in order to do so,he uses force on any person or puts or seeks to put any person in fear of being then and there subject to force]""
And with the highest respect for the office of the DPP and his competent staff and their constitutional authority under section 59 of the V.I Constitution,I ask the question in the interest of the public and in the name of justice for RiteWay and other victims of Theft:
"Is there a justified public reason,why the accused was not charged on indictment,for theft under section 209 (B) of the BVI Criminal Code,of Her Majesty's Laws of 1997?

Conspiracy is an agreement between two or more persons to engage jointly in an unlawful criminal act.
In this case the conspiracy to rob is alleged to have taken place on or before the date of the staged robbery.
The fact that the defendant was the staged victim matters not, he has still conspired , or planned with others a robbery.
The reason in law that conspiracy is seen as a more substantive crime is because the potential for criminal activity increases with two or more people agreeing to commit a crime.
Conspiracy can be with persons unknown, or as in this case, hopefully with other named persons.
I hope when they rob you they get away. Such an "$$!!
