ROAD TOWN, Tortola, VI- Following our article this morning, July 19, 2023, that some staff of HM Customs were planning to strike due to non-payment of increments, the Government of the Virgin Islands has issued a brief statement denying the planned industrial action.

In the statement headlined ‘No threat of strike by Customs Officers’, Government said the Deputy Governor has met with members of the Customs Staff Association “and would like to dispel any rumors of Customs Officers striking due to outstanding increment payments. A press statement will follow shortly.”

Further Premier and Minister of Finance Dr the Honourable Natalio D. Wheatley (R7) told a local news outlet, “News reports that Customs was planning a strike this morning are false. Myself, the Deputy Governor, the Financial Secretary and members of the Customs department had a meeting discussing various areas of concern for Customs.  The spokesperson for the group made it clear that no industrial action was planned. 

Dr Wheatley said the goal of HM Customs was to have a meeting where they could get feedback on their concerns.

The Premier added that the meeting, held just after 7:00 AM, before regular working hours, “was very productive and a number of action items were committed to in order to address the concerns,” Dr Wheatley said.

Aggrieved staff members of HM Customs are still sticking to their story that they were preparing to take industrial action if their concerns were not met.

An emergency meeting is in progress between Deputy Governor David D. Archer Jr and senior persons in His Majesty's Customs in an attempt to avert a strike action planned by some staff of HM Customs today, July 19, 2023.

According to reports reaching our newsroom from sources close to the situation, some staff, especially lower-tiered staff, are aggrieved they have not been paid their promised increments, even though payments are reportedly being made to senior staff.

The frustrated staff members had planned a sick-out today.

The meeting with the Deputy Governor reportedly convened just after 7:00 AM.

Our News Centre will bring more details to this story as they come in.

      Once again, the Premier seeks to insult the publics intelligence. Why would any organization that's not backed by a trade union proclaim that they are going to strike? Plus, the Public Service regulations prohibits the Public Service to strike. There are other methods to collectively resolve such issues...and he knows it.

      When the country was in lockdown and government employees were getting there full pay was it not Government that made sure they got paid even though the circumstances but there is a solution down size the government get rid of some of the employees and there will be sufficient cash to increase salaries point blank send home does that have reach the 25 and 33 mark make it mandatory to leave.

    This move was expected. You don't have to worry about the Immigration Officers doing this though. They are too caught up undermining each other so there won't be any unified attempt to pursue what is owed to them.

      I bet you just about every department would have been staging some form of protect for their increments this year if NDP got in. They couldn't organize their own leadership... how would they organize the Public Service's purse?

    Government please just pay the people so that the country can run in peace. If customs and immigration strike, all the ports will have to close. We cannot afford this. Innocent passengers both arriving and departing the island are left holding the bag with having to pay for new tickets, missing their surgeries and medical meetings, connections and all kind of things. It is far reaching and the people is who suffering. Pay up the people who are due their increments let us move on. It have people who fraid to come here right now for fear that they will either not reach or leave as schedule.

The civil servants are struggling to make ends meet because of the high cost of living implemented by the same worthless govt officials who continue to oppress their own ppl.     I agree with BVI Customs decision, negotiation held before force to strike.
    I call on the current Premier and his Ministers to swiftly negotiate seriously with the underpaid government workers across the board (every department). Empty promises are missing the mark too often. Put up or shut up. Pay up or or be face with a vote of "No confidence."

    Undoubtedly, workers have the inalienable right to a living wage, and to work in a safe and healthful environment. Industrial relations actions are driven primarily by two things a) pay, and b)working conditions. The former, pay, seems to be spreading like a wild fire on a prairie. TBLIA fire officers sickout yesterday disrupting airport operations. Now that sickout disease seems to be spreading, and if not addressed and arrested soonest the economy can be crippled, trying to recover from the Covid-19 pandemic. This supposed industrial action can impact airlift operations. Under whose purview does the civil service falls ? The Governor. The Governor needs to get it done effectively. Payment seems to be a bone of contention. Is increment compulsory under the contract between employees and government, or discretionary based on performance? If the former, the Governor needs to take urgent action to ensure that the government is meeting its obligation. If the latter, the Governor needs to ensure those that earned increment through performance appraisals ratings also gets paid. The civil service process is disjointed and ineffective. The government provides the funding and needs the services to govern but the civil service falls under the Governor. This sound like an Brer Anansi tory. The civil service needs to come under local government control. From management science , it is challenging to manage something you don’t control over but responsible for and will get blame for. Dr. Hon Premier Natalio Wheatley, Hon Lorna Smith, it is time to weigh in on the labour issues which is threatening to take on a wildcat life. This could derail the ability to effectively govern. A band aid solution is not the fix; it needs a long -term solution. Let’s geh ah dun and give every manjack his/her just due and let the territory soar.

    We need to be careful about winning battles but losing the war. Country shouid come first but country should do the right thing for the people. Both sides must compromise ( governing is about compromise and no side will get everything it needs) to get to the desired state. If the goose that lays the golden eye is slaughtered? Is that the desired state??? Our leaders must lead us out of this abyss.

    The bvi leadership has become void of ideas nothing is working at the moment, everything seems to be in shambles with no end in sight.
    I understand the civil service staff frustrations and other entities who are promise monies for remuneration of service and unable to received it but you have the same government spending monies on frivolous stuff. I get that and understand it.
    What I don't get is civil servants in 2023 getting up and taking industrial action when they want to, disrupting public services to jhon public, I believe the time is ripe to have legislation in place for these bodies to give notice when they are going to strike, so that members of the public are aware in advance so they can plan around it, as in our case, travelling to San Juan but the airport is close. There must be a balance and I believe that government has misunderstood the people, we are living in different times and people are waking up.

    I want to ask Mr. David Archer a question.

    What do you mean by 'eligible' officers? Please explain. The reason I ask this is because the government has workers employed and no evaluation has been done for the years in question: 2018, 2019, 2020, 2021, 2022(if I am correct). How can the government wait until 2023 and have the Heads of Departments/supervisors rush appraisal forms, give some good appraisals and some bad appraisals? If an employee was not doing well why wasn't that communicated? Why weren't the heads of departments doing the appraisals at the end of every year? They weren't doing their jobs, yet they are getting their increments, but those who they give bad appraisals not getting any. This is injustice!! ALL CIVIL SERVANTS should receive their increments and then start afresh. If people are not doing their work from here on, send them home. The private companies do not operate in such an unprofessional way! Y'all should be ashamed of y'all selves!

      I agree with you. The increments should be given on the basis that inflation rates and cost of living has gone up ALONE. It is time for the basic rates of pay for each and every one of those roles to go up. Afterwards, then they can follow through with annual appraisal system.       Why are Water and Sewage employees working overtime without compensation? Are the employees hourly ( eligible for overtime) or At Will employees who generally are not eligible for OT but are eligible for compensatory time. What does the labour code say about overtime? If the code stipulates that hourly employees are eligible for OT but they work OT without compensation, the Labor Department shouid investigate so that employee can be whole. We need to stop the practice of contractors and employees from funding government. Is not the role labour Department to ensure that the Labor Code is followed.
