UPDATE: ‘Cussing’ matter stalled with lack of translation

ROAD TOWN, Tortola, VI – The matter involving a woman who admitted to ‘cussing’ out a Police officer has found a hiccup before the Magistrate’s court following a disclosure that there has been no forward movement by the prosecution.

Senior Crown Counsel Valston Graham revealed that the defendant, Elizabeth Turnbull, has not been given the Spanish translation of her documents as yet in order for the Crown to proceed with the case.

The defendant, 23, of Baughers Bay, was born in Santo Domingo but is now a Belonger in the Territory but reportedly does not speak English well. She is accused of indecent language and throwing missiles. The unrepresented accused pleaded not guilty to both charges when she appeared before the court on February 4, 2013.

Graham told the court if at the next occasion the translation was not made available as yet, the Crown would not offer evidence in the matter since the justice system could not be held at ransom.

He indicated that both the Director of Public Prosecutions (DPP) and the Commissioner of the Royal Virgin Islands Police (RVIPF) have stated that they would not be paying for the translation of the defendant’s documents.

The defendant told the Magistrate that she does not speak English.

The matter is set for hearing again on June 7, 2013.

ROAD TOWN, Tortola, VI – Elizabeth Turnbull, 23, of Baugher’s Bay admitted before the Magistrate’s court yesterday, February 4, 2013 to charges of indecent language but denied that she had committed any assault or threw any missiles on November 11, 2012 in Sea Cows Bay.

Turnbull, who was born in Santo Domingo but is now a Belonger, was initially charged with assault on Police, indecent language, criminal damage and throwing missiles.

Senior Crown Counsel Valston Graham told the court that the criminal damage charge would no longer be pursued due to lack of support from the Virtual Complainant (VC). She pleaded not guilty to the other two charges of assault on Police and throwing missiles.

The woman allegedly told an officer, “I ain’t fraid of no [expletive] Police; I aint’ going no way with no [expletive] Police.” Notably, the young lady required an interpreter at her arraignment since she related that she could not speak the English language fluently.

The defendant was unrepresented at the time of her appearance and was placed on $35,000 bail with one signed surety and asked to return to court on March 1, 2013.

      i was here wondering the same thing. she obviously was not here long enough to become one or she would have understood enough of the language to not need an interpreter. Maybe she was pretending to not understand in hopes of some liniency or she got belonger's status because she's the child of a B.V.Islander.

        A lot of persons from other countries migrate to the BVI, and unlike us (yes I'm a BVIslander, 100% born and breed) they give birth here. We are giving birth overseas. We are decreasing the numbers of our natural heritage and others (expatriates) are increasing the numbers of the Belongers. For this reason, I have vowed should I have another child, he/she will be born right here. The plus side is that our children born overseas are entitled to dual citizenship. However, their offspring will not be able to have all the perks our children have. Additionally with the US and other countries changing legislation frequently, it may soon become a a dual history. Pay attention people.

    Chapter 1 Interpretation 2 (2) of the BVI Constitution states:
    ""For the purposes of this Constitution a person BELONGS to the V.I if that person-
    (a) is born in the V.I AND [at the time of the BIRTH] his or her father or mother is or was-
    (i) a BOTC(or a BDTC) by virtue of BIRTH,REGISTRATION or NATURALIZATION in the V.I or by virtue of DESCENT from a father or mother who was born in the V.I.
    (b) Is born in the V.I of a father or mother who BELONGS to the V.I by birth OR DESCENT or who,if DECEASED,would, if ALIVE,so belong to the V.I.
    (d) Is born OUTSIDE the V.I of a father or mother who is a BOTC by virtue of BIRTH in the V.I or DESCENT from a father or mother who was born in the V.I or who BELONGS to the V.I by virtue of birth in the V.I or DESCENT from a father or mother who was born in the V.I.
    According to the V.I Constitution,provision is made for a person to be recognised as belonging to the Virgin Islands by VIRTUE of a THIRD generation [The Great grand child of a Born-BV-Islander/Belonger] is also a belonger! It does not matter where that Great-Grand-Child was born; in the V.I or outside the V.I. The Constitution is the SUPREME law of the land: The V.I belongs to Her Majesty-The Queen, BUT there are Classes of persons Who are DEEMED to BELONG to the V.I. and such classes of persons have ALL the rights in Her Majesty's V.I. Countries and Territories do NOT belong to citizens! Citizens BELONG to Countries and Territories: Elizabeth Turnbull who was born in Santo Domingo may well be a great-grand-child of a Belonger/Bv-Islander: Therefore,the V.I Constitution,DEEMED her to be a BELONGER!!

      But make sure you interpret each instance of "child" as "LEGITIMATE child" because rights do not extend to illegitimate children of BVI fathers. And how many of those migrant BVI men married those Santo Domingo women? Right, I thought not.

        once the father claims the child,that child is LEGITIMATE;if you mean married to be LEGITIMATE,the V.I Constitution does not make provision for MARRIED or UNMARRIED: The Constitution declares-Mother or Father. If a married-man who is a born-belonger/bv-islander cheat and he fathers a child outside of marriage,though his action is socially wrong;if he claims that child to be his, then that child is deem to belong! Because the V.I Constitution did not make a distiction for who is "LEGITIMATE" or "ILLEGITIMATE". you may wish to read that in Chapter 1 interpretation 2(2) of the V.I Constitution.

    PROVISION TO SECURE PROTECTION OF LAW:
    Section 16 (1) of the Virgin Islands Constitution States "" If any PERSON is charged with a Criminal Offence,then,unless the charge is withdrawn,the case SHALL be afforded a FAIR hearing within a reasonable time by an independent and impartial court established by law"":
    Section 16 (F) States [The accused shall] ""Be permitted to have [without payment] the assistance of an INTERPRETER if he or she cannot understand or speak the LANGUAGE used at the TRIAL of the CHARGE"".
    I have the GREATEST respect for Senior Crown-Counsel Graham; BUT the V.I Constitution directs that any INTERPRETATION MUST be paid for by someone OTHER than the ACCUSED. So the CROWN MUST PAY for any kind of INTERPRETATION! The Constitution is a DECLARATION by Her Majesty-The QUEEN,to ALL persons of the BVI[Citizens] and All residents [Expatriates].Her Majesty's Instruction in Her V.I Constitution-Declaration, MUST be obeyed!

    d p p and c o p saying dem not paying for translating docs but look i reading de law on a vino blogg that is crown who hav to pay for everything to do with interpreting. people,doh wish bad for elizebeth because u may be arrested tomorrow any one of us can get into a little tie up with the law and we will want the d p p and c o p to do what the constitution say to do. i learn something now about the law and trial of persons with foreign language.that is what blogging is about.we should all go and read the constitution to see our rights,now a days those in top position doh want us to know of our rights,they keep everything secret,no programs on radio and tv about rights and what to do if your rights are violated on the job or by police or whoever,look is on vino i have to read on who really belong etc..we need to make our very children understand their rights,i respect the term 'ah born here' but remember if a child 'born here' and the mother and father not belongers that child have no rights in the bvi. the child hav to get the rights of it non-belonger parents.the child 'born here' but is 'not from here'. children get parents rights and not necessarily 'birth rights'. nice blogging on the constitution on who really belong and should pay for interpretation.thanks.one love

    so if a belonger bvi woman make a child in the bvi outside of marriage and the father is from tim bok 2,the father is not a belonger, are you saying that the child is illegitimate?i read the part in the constitutionm myself and it say "mother or father" born in the bvi. so whose rights the child should get in the bvi? the father from tim bok 2 or the mother from the bvi who is also a belonger? this saying "illegitimate" is a old time talk to mean born out of wedlock,and people in government offices like passport office come up with their own law of distinction "legitimate" and "illegitimate". until someone take them to court for them to define what is illegitimate child and legitimate child in the bvi law,they will continue to classify and distinct.this topic should be discuss on a talkshow with a lawyer to explain who really belong to the bvi under the bvi constitution.for too long now,we are not sure who belong or not belong.which law that say rights do not extend to what we call "illegitimate child"?where is the bvi law which define "illegitimate child". nice topic.
