UPDATE: Complainant still interested in ‘kissing intruder’ matter - Crown
Crown Counsel Valston Graham told the Magistrate’s Court on April 26, 2013 that Jamaican national, Peter Gray, will still face trial for the offences of trespassing and indecent assault as the Virtual Complainant (VC) was still interested in prosecuting the matter.
The VC previously had issues that restricted her from appearing in court as a result of her job, but a summons has now been done to secure her attendance.
According to the allegations, the defendant allegedly unlawfully entered the premises of another in the vicinity of Sophie Bay, Tortola July 12, 2012 and assaulted a young woman.
Gray pled not guilty to both of the offences before the court on August 15, 2012.
The defendant remains on $55,000 and also has another pending matter before the court currently.

Alleged "kissing" intruder to face trial
ROAD TOWN, Tortola, VI – Jamaican national Peter Gray, who is accused of alleged indecent assault and criminal trespass, is now scheduled to stand trial for the accusations.
When the matter was brought before the court on October 12, 2012, Crown Counsel Leslie-Ann Faulkner announced that there was some difficulty in having the Virtual Complainant (VC) appear in court due to job related difficulties. Ms Faulkner indicated that a summons may be necessary to secure a release from her employer to attend court. Magistrate Tamia Richards agreed that this should be done.
Gray had pleaded not guilty on August 15, 2012, to the charges brought against him by the crown.
Ms Faulkner had then explained that during the day of July 12, 2012, the defendant allegedly visited the home of the VC, unlawfully entered her home and assaulted her.
In Ms. Faulkner’s report, she disclosed that at the time, while the VC was resting, she allegedly felt someone kissing her on her ear, but paid it no mind, thinking that it was her boyfriend. The court was further informed that because the kissing on the VC’s ear continued, she turned around and realized it was not her boyfriend, causing her to jump and scream; the defendant then left the room.
The report further indicated that the defendant allegedly came back into the room, held the VC’s feet and forced his head between her legs, forcing her to scream and struggle for help.
The court heard also that the defendant allegedly told the VC "this is going to be between me and you”.
In a summarised report coming from the VC, it was revealed that she told officers of the Royal Virgin Island Police Force she was unable to move because of the force Mr. Gray had on her while holding her down.
The report from police officers also quoted Mr. Gray as stating he was invited to the home, so he should not be charged with trespassing.
It was stated that the defendant and the VC were friends before the incident.
Mr. Gray, who has been in the Virgin Islands for eight years and was represented by Stacy Able, was placed on a $55,000 bail with two sureties and is required to pay a $5000 cash component.
He was also required to visit the East End Police Station every Monday, Wednesday and Friday between 6 A.M. and 6 P.M. as well as hand over his travel documents to the authorities.
Gray will return to court on October 26, 2012 for trial.
