UPDATE: Carey & Ashby cleared of robbery charges!

ROAD TOWN, Tortola, VI - Royston Carey and Michael Ashby were on January 25, 2013 granted their freedom before the Magistrate’s Court after a robbery charge against the men was dismissed for want of prosecution. The men were previously on bail.

Ashby also has a pending court matter of assault allegedly committed against his wife.

The duo was accused of entering a bar and taking $5000 from a patron (VC).

During a previous hearing of the case, the Virtual Complainant (VC) indicated to Senior Magistrate Tamia Richards that he was no longer interested in pursuing the matter. The VC was informed, however, Director of Public Prosecutions (DPP), Wayne Rajbansie was the only one with the final say on the course of proceedings.

Magistrate Richards had related that the case was not brought before the court by the VC, but rather by the Crown on behalf of the State and as a result, any withdrawal of the charges would be at the DPP’s discretion. He was asked to relay his concerns to the Office of the DPP.

Ashby & Carey granted bail!

Wife says she is afraid when husband is angry 

ROAD TOWN, Tortola, VI – Tiffanie Ashby, wife of robbery accused Michael Ashby, appeared before the Court yesterday August, 22, 2012 and expressed to the court that she is afraid of her husband when he is angry. Mr. Ashby is also charged with assault against his wife.

In mitigation for her husband, Tiffanie Ashby, who is employed with the Taxi Stand at the Ferry Terminal, told the court that she would like her husband to just get a warning or to attend counselling. 

She informed the court that she works four days a week, and the defendant helps her out at home.  

Despite all this, she stated that she is afraid of Mr. Ashby when he is mad; she added that he doesn’t control her but when he is angry she is scared. 

The court understands that the couple have been married for five years. 

In mitigation, Mr. Ashby said he is very sorry for hitting his wife, “it was just a little misunderstanding.” He asked the court for leniency for him to support his family and added that he won’t do it again. 

The 29-year-old defendant, said he needs to get back into society to get his life on track. “I can’t support my family from jail.” 

Along with the charge of assault against his wife, Mr. Ashby and another man by the name of Royston Carey, were also charged with robbery. 

Ashby and Carey allegedly robbed Bassano Hendrickson of $5000, while at Violets Bar. 

Ashby is currently on $100,000 bail with $40,000 cash component, while Carey is on $100,000 bail with $50,000 cash component, each with two sureties. 

Both are to report to the Road Town Police Station every Monday, Wednesday, Friday and Saturday from 6am-6pm. They are to surrender their travel documents and have no contact with the Virtual complainant or witnesses in the case. 

Mr. Ashby’s bail requirements apply for both cases. 

Both are to return to court on October 1, 2012.

    Sweetie, thats your husband. This time is a blood shot eye, next time you dont know. Which time will be the bodybag If this happens once, and by your words; this is not the first. It will continue to happen, until it is too late. Take this as your out, he needs some cooling time up Balo. Use that time and concentrate on you, God will send you send one better.     I agree with you 100%. Unfortunately, battered women have usually lost all self-worth before the first punch. If they had any love for themselves, they'd leave the brute immediately. Women who accept their fate at the fists of their man and live in fear of their anger usually believe they are reliant on that man for survival. But why they need a man to help support them when there are also family and friends (who truly) love them is the one million dollar question. The local woman support groups really deserve some free advertising. There are far too many woman in abusive relationships in our small community. They need to know there are places to go to escape the man. They need to know there are people that will help them to move on in life and discover a better life. They stay where they are because they are afraid they won't have food, shelter, money and yes, even love. They don't realize they deserve far more and that love never should hurt.

    I am saddened when I read about these women staying in abusive relationships because of financial reasons. Ladies, if you can't manage to live in Tortola without these abusive men, GO BACK TO YOUR NATIVE COUNTRY. It cannot be that bad in your native country you would prefer to stay in an abusive relationship that may just cause you your life!

    In my 34 yrs of livin,as a male i realize that no man should lay their hands on a woman,but as he gets older he would come to do the same.Im sorry that she probably had to go through such and i know the young man and will offer some advice to him when i get close to him again....what he allegedly did was wrong by many moral standards but how many of you females suffered even worse fates with your boyfriends or husbands and stayed with them up to now and then wants to cry out leave him.....im just sayin....One of the things that comes to me all the time because i grew up around four sisters is that god in all his infinite knowledge had a son but theres nothing tellin me that he was married......mmmmmm wonder why????......
