ROAD TOWN, Tortola, VI – Senior Magistrate Valerie Stephens has denied bail to Franklyn Malone, a 53 year-old Virgin Islander charged for allegedly threatening to kill his ex-lover, when he reappeared in the Magistrate’s Court yesterday April 4, 2012.

In handing down her decision, the Magistrate stated that the case is a “serious and compelling one”.

The court heard that Malone has allegedly threatened to blow up Carol Williams, the Virtual Complainant’s (VC) home; kill her and feed her body to the fishes and even allegedly told an Immigration Officer that he would “kill Carol”.

On April 2, 2012, Malone had pleaded not guilty to two counts of criminal damage. However, he was not required to plea to the threatening to kill offence, and because he was unrepresented he had to return yesterday with a lawyer to make a bail application on his behalf. Malone has since obtained the services of Herbert McKenzie.

In objecting to bail, Crown Counsel Janice Potter disclosed that the VC had a heart condition that is exacerbated by stress and anxiety. She also revealed that on Monday the VC suffered an anxiety attack which prompted officials to call an ambulance. “She is very fearful of Malone.”

According to the Crown, Malone and Williams were in an intimate relationship that ended, but they continued to live in the same apartment on Tortola. However, she moved to Virgin Gorda (VG) after allegedly being verbally abused and threatened by the defendant. Despite this move, the court heard that Malone visited Williams’ VG apartment on several occasions unexpectedly.

On March 26, 2012, the VC allegedly asked Malone to leave the apartment and installed new locks to her door. They had an altercation in which the defendant allegedly threatened to blow up the house.

Then on March 28, 2012 during an altercation, he allegedly threatened to kill her and feed her body to the fishes.

The following day, March 29, 2012, the VC left her apartment for a doctor's appointment but realized she had left her money at home and upon her arrival she found her back door lock and a window prised open. She made a report to the VG police station, and while there Malone allegedly called her on her mobile prompting the VC to place the call on speaker.

The Virgin Islander allegedly told the VC if Immigration did not put her out, he will kill her. Additionally, he allegedly revealed that he was at her apartment.

When the VC arrived home, she found her gas stove was on and a strong acid scent of gas emanated throughout the apartment. The front window lock was prised open, and the back door lock was damaged. The Police were called in.

Furthermore, Crown Counsel Stoutt disclosed that the VC received a call from an Immigration Officer (IO), who informed her that Malone had made a report regarding his passport. It is alleged that he told the IO if he did not get his passport he will kill the VC.

Subsequently, Malone was questioned by Police and on March 30, 2012 he was officially charged with criminal damages and threatening to kill.

However, his lawyer McKenzie told the court that his client is ready to fight the charges. Malone has two children and works as a driver and part-time at a supermarket in VG.

A Preliminary Inquiry (PI) is set for April 30, 2012.

      here we go again with some who do not fear the law. It seems like the courts always giving them light sentences and they always hurting or will end up killing or abusing some of these innocent women. We cannot afford another Kay let's deal with this issue before it gets out of hand...women my message please do not be afraid to walk away.

    This scorned man should have been charged with attempted murder. I wonder what the crown was thinking? Don't they believe that if a person left a gas stove on that the person who did it was attempting to kill? These useless scorned less than men who cannot go their way when a relationship clearly ends need to be hauled before the court like this one, and if convicted of a crime needs to be then dragged off to jail. He is a danger to this woman and society, and needs to be taken off the streets before he records another homocide.

    What is wrong with this guy? He got away years ago with killing a police office you think he would change. He should to charge with attempted murder. Send his a-- to jail for life where he belongs. When is this kind of stuff going to stop? Get real virgin Islanders, time to clean up the tiny island. Get rid of the bad apples.
