ROAD TOWN, Tortola, VI – Allister Browne, the man that pleaded guilty to having over one kilogram of cannabis in his possession recently, has had his sentencing put off for another date due to the absence of sentencing guidelines in his case.

When the defendant appeared before the Magistrate’s Court on July 24, 2013 he was told that the necessary guidelines were not submitted by the prosecution for his sentencing and he would need to be brought back from remand to have this done.

Browne of Little Dix Hill pleaded guilty to possessing 1.44kg of cannabis but this was lager changed to 1.3kg after an analyst’s report was issued on the substance. He had also pleaded not guilty to the charge of intent to supply the cannabis when the charges were initially read.

According to the facts of the matter, Browne’s Little Dix Hill home was searched based on a warrant on January 20, 2012 and officers allegedly found cannabis in various areas of his house, including his living room and kitchen.

Browne will now know his fate on July 31, 2013 instead.

UPDATE: Allister Browne remanded for sentencing

- accused of possessing 1.44kg of cannabis

ROAD TOWN, Tortola, VI – Allister Browne of Little Dix Hill was remanded to Her Majesty’s Prison pending sentencing after the Crown decided that it would pursue drug charges against him on June 28, 2013.

Browne pleaded guilty to drug possession charges previously but not guilty to charges of intent to supply.

According to the facts of the matter, Browne’s Little Dix Hill home was searched based on a warrant on January 20, 2012 and officers allegedly found cannabis in various areas of his house, including his living room and kitchen. The cannabis that was allegedly discovered reportedly weighed 1.44kg.

The marijuana initially weighed 1.44kg but was later changed before the court to 1.3kg after the analyst’s report had been completed. The substance reportedly has a street value of $13,000.

Senior Crown Counsel Valston Graham told the court that something is known against the defendant for a “similar but greater” offence. Browne was previously placed on $25,000 bail.

Senior Magistrate Tamia Richards said Browne would be remanded until sentencing on July 19, 2013.

UPDATE: Crown to decide fate of ganja accused Allister Browne 

ROAD TOWN, Tortola, VI – The Crown requested an adjournment today, May 7, 2013 in the matter of Allister Browne, of Little Dix Hill, who is before the Magistrate’s Court on charges of possession of an uncontrolled drug and intent to supply the said drug. 

Browne pleaded guilty to the charge of possession when he appeared before former Magistrate Valerie Stephens on September 12, 2012 and not guilty to the charge of intent to supply. He is represented by Attorney at law, Marie Lou Creque.

According to the facts of the matter, Browne’s Little Dix Hill home was searched based on a warrant on January 20, 2012 and officers allegedly found cannabis in various areas of his house, including his living room and kitchen. The cannabis that was allegedly discovered reportedly weighed 1.44kg.

When the matter was heard today, Senior Crown Counsel Sarah Benjamin told the court that she did not have conduct of the matter and would be seeking an adjournment as a result.

The prosecution also intends to ascertain whether they will proceed with the charge of intent to supply against the accused.

Senior Magistrate Tamia Richards noted that the defendant would have to be re-pleaded before her when the matter comes up for hearing again.

Browne remains on $25,000 bail and will return to court on June 14, 2012 when a decision is expected from the Crown in the matter.

Officers find Cannabis at man’s house

-Pleads guilty to possession, not guilty to intent to supply

ROAD TOWN, Tortola, VI - Officers of the Royal Virgin Islands Police Force (RVIPF), while searching the home of Mr. Allister Browne, who resides in Little Dix Hill, allegedly found 1023 grams of cannabis in different areas of his house.

Mr. Browne who appeared before the Magistrate’s Court yesterday September 12, 2012, pleaded guilty to possession of the uncontrolled drug, but pleaded not guilty to intent to supply the drug. 

The particulars of the case are, on January 20, 2012 in the defendant’s home at Little Dix Hill, officers who had in their possession a warrant to search the premises where Mr. Browne resided, met the defendant on the outside of his home, identified themselves as officers of the RVIPF and made him aware of the warrant. 

In the facts that were presented to the Court by Crown Counsel Janice Stoutt, the Court heard that the defendant allegedly, ran into the house and locked the doors. 

She further stated that after several attempts of negotiation with the defendant to open the door, one of the officers broke a window, as a means of entrance, but the defendant then opened the door. 

According to the officer’s statement, while conducting the search, a plastic bag of cannabis was allegedly found in his living room, along with two large zip lock bags and five ball shaped objects covered in tape. The ball shaped objects contained cannabis, according to the statement. 

When officers showed the defendant what they recovered, allegedly the defendant said “it is weed and it is mine, officer is weed in all of them.” 

Moving to the kitchen of the defendant’s home, the court understood that on top the refrigerator, officers found an orange bowl with cannabis, along with a scale, also containing cannabis. 

Allegedly, cannabis was also found in a silver pot on the counter of the kitchen, and a white plastic bag with weed and a branch from off of a shelf. 

Mr. Browne is currently on $25,000 bail and is required to visit the East End Police Station every Monday and Thursday, as well as handing over his travel documents. 

His matter is set for trial on November 19, 2012, where two witnesses will be present.

    There appears to be different standards given by the courts when it comes to possession of Cannabis. How is it some offenders get sent straight to prison until their court dates for lesser quantity, and others are granted bail...does it matter who you are and where you live? or it depends on how the Magistrate feels that day?

    people of the bvi so afraid of the truth, they love living in fear, & fear to face the truth.
    i'm not a smoker or someone that use the herbs, not one time i ever smoke or sell it,but i have done my home work & ahve notice they is no harm is the herbs, no man woman or child have even die from it, just google people who died from herbs? none, so why is the bvi government so uptight about it? whats they so afraid of & for? most of you who saying this & that have not one time did your home work about the herbs, you all just say thing & thet, how can you tell people about jesus or the bible if you never read it? so you be telling people hear say? come on bvi, just asking you one time, just research that's my point!

    It's just not worth it i'm not a smoker either and I don't believe herbs are as bad as they make them seem like other drugs once not abused but right or wrong,its presently illegal and just not worth getting caught with it people. Use it when go somewhere on vacation where its legal.

    I'm not a smoker, and i'm not saying to break the law is right, but i believe that something is wrong with the system,to me it appears that the law is lenient on you base on what you sell, you give suzie, professor or reymond $5 in broad daylight and you'll see where they are going, full speed, non stop.
