UPDATE: 20 months behind bars for Credgton Smith

ROAD TOWN, Tortola, VI – Mr Credgton Smith, who was found guilty on charges of guns, drugs and ammunition possession, will be spending some 20 months behind bars.

This was a decision handed by Senior Magistrate Ms Tamia Richards on Friday December 6, 2013.

Mr Smith was found guilty on December 4, 2013 for the offences of drugs, gun and ammunition possession allegedly committed in 2008 and Magistrate Richards had remanded him to prison. He was found not guilty for unlawful possession of cannabis with intent to supply.

When he reappeared for sentencing, he was slapped with 20 months for unlawful possession of a firearm, 5 months for unlawful possession of explosives and fifteen months for unlawful possession of cannabis.

Credgton Smith found guilty of drugs, gun & ammo possession

- To be sentenced on Friday, December 6

One of the oldest cases before the Magistrate’s Court of the Virgin Islands came to the point of decision last evening, December 4, 2013 when Senior Magistrate Tamia Richards found Mr Credgton Smith guilty for the offences of drugs, gun and ammunition possession allegedly committed in 2008.

Smith was charged for unlawful possession of a firearm, unlawful possession of explosives, unlawful possession of cannabis and the unlawful possession of cannabis with intent to supply. He was found guilty for the first three offenses and not guilty on the latter.

According to the evidence given in court during the trial, the drugs and ammunition were found in an apartment called ‘The Pussy Cat Lounge’ at Carrot Bay, Tortola. The prosecution said the accused was not in the apartment at the time of the discovery made by officers of the Royal Virgin Islands Police Force (RVIPF), however, it was believed he was residing in the lounge.

A number of evidences, including a box with his name where some of the drugs were allegedly found, pinned him to the crime, the prosecution alleged.

His lawyer Stephen Daniels, in pleading for leniency in sentencing, told the court that his client was no criminal and the court should consider the circumstances surrounding the conviction. He told the court that since the offence has aged from since 2008, his client would have paid the penalty and sufficiently punished over the time.

Daniels told the court his client has since married a senior person at the BVI Health Services Authority (BVIHSA) and giving him a harsh sentence could be tough on the couple. Mr Smith, 55, is to return to court on Friday December 6, 2013 for sentencing. He was remanded to prison.

    Like I am saying because he married a senior person in the Health Services he should not pay for his crime? so if he was married to somebody that does not hold a BIG job that is Ok for him to go to Jail?? bull $%^& you do the crime you serve your time Period

      I understand and let's reflect once again if we must...the case against a certain daughter...she too because of her mother status at that time was given community service for a "felony" such taking drugs into the jail...and then her file was permanently erased....please what a message for those who have no such family members, etc. working in the right places or have a name that seems to carry prestige....let's wait patiently for the DeCastro case...that might be another "name sake" incident....this happens all over the world....every day such affairs is in the news...slap on the wrist all because of $$$$$ they have or name sake...

    I am not rejoicing but is just how they treat Dr. and the staff of the hospital like dirt. **** has no compassions or love in her judgment for the people she leads. Alone with big eye they are just unfit for the Health Services top positions, I just good people like Dr. Georges were not appreciated . as a result all of us suffered the disrespect and victimization of the chief of medical staff office. sabotaged with regards to continuation of contracts month of waiting without time in the country just to name a few. But God time is the master of things. let they pay for all they have done to all of us. Dr. Australia

      You really sound like you have some built up anger, may-be you should talk to somebody about that so you can let somethings go. Ever heard the saying, one door closes another one opens. Then again if you did not learn your lesson, you might stand outside the first door complaining instead of going to find your open door.

        The man in Australia making plenty more money than he was making here or you could dream of, with the chance of residency in much less than 25 years, and the ability to do advanced training and improve his career and salary prospects. I think the door was open and he walked happily through it while the Diva and Popeye thought they were closing it on him. Please get a life.

        If he looks back and talks about how poor his experience was in the BVI at the hands of a certain woman and Dr. pop-up-eye and comments that Karma is beatch, aint nothing wrong with that

    When you're planning and scheming in digging holes for people you have to always prep one for yourself because you will fall in it!         you sound like a paid HSA staff blogger I guess from the PR Department.
        Obviously you never suffered at the hands of this woman and her accomplice, Dr Pop-up-eye. Complaining to the Minister and Board is pointless as they are wrapped around their fingers.     Something is wrong here! Why did this case take so long to be tried? Is that Justice? The Crown seems to be infringing on basic human rights. The rights of a person to be tried for an alleged crime,in a timely manner.

    Wait a minute: "That case of COP vs Credgton Smith,was still pending in a Court-of-Law? Unbelieveable!!

    That is where we have a break-down in the BVI Justice System: While I believe in the saying""If you do the crime,you must do the Time" I also believe in the saying ""Justice DELAYED is Justice DENIED"". In this particular case I will support ""Justice delayed is Justice DENIED"" And this is why I make my claim:

    It's on a Constitution point,and I must add,that is where a Legal Professional [A Lawyer] should step-in and use the Power of the V.I Constitution:

    Section 16 of the V.I Constitution states:-

    ""[Provision to secure protection of law]""

    ""If any person is charged with a Criminal Offence,then,unless the charge is withdrawn,the case shall be afforded a FAIR hearing within a REASONABLE TIME by an Independent and Impartial Court established by law"".

    The Legal Question here in one sentence is ""Would five years be considered as (REASONABLE) time to try I summary case?)..

    That would be a matter for an APPEAL'S court. BVI Lawyers,please step up!

    Don't blame it on the Magistrate-

    The job of the Magistrate is to Convict and Sentence-According to law.

    It is for the defense to File a motion in the High Court,under section 31 of the V.I Constitution:

    This DELAY in prosecution,is a clear Contravention of "Fundamental Rights and Freedoms of an Individual"

    under Chapter 2 of the V.I Constitution..Justice delayed-is justice denied.
