UK unlikely to grant request to remove Order in Council– Hon Malone

- said it would not be in keeping with UK's agenda

ROAD TOWN, Tortola, VI – Opposition Member in the Virgin Islands (VI) House of Assembly (HoA), Hon Carvin Malone (AL) has warned that should the VI ask to have the United Kingdom (UK) remove the reserved Order in Council to suspend the VI constitution, it may not oblige.

Hon Malone made the comment while appearing as a guest on JTV’s The Big Story on August 9, 2022, with host Cathy O. Richards. 

Conditions already agreed to - Hon Malone 

“We have an order which has been laid and basically the Governor has clearly stated that unless each and every one of the conditions that were agreed are adhered to… or put in place, then he can wake up one morning, call the office, have it gazetted… and that is done,” he said.

“They would not have to go back to the House of Parliament. You asked the question the other day, did you seek to get it off? I would put it to you that even if you seek to get it off, you would not get it off.” 

Hon Malone said should the UK withdraw the Virgin Islands Constitution (Interim Amendment) Order 2022, that would significantly hamper their plans, starting with the Commission of Inquiry, which was a conclusion already written.

“This is the path that they intend to go with all of this. What we've done here also is that most of the suggestions for changes to the Constitution are now being embedded in the terms of reference of the new constitutional review.

“The answers to what we're asking the Constitution Commission to look at, had already been suggested by the Commissioner,” he said. 

VI people must fight for what they want - Hon Malone 

Hon Malone illustrated that matters to be addressed in the VI’s constitutional review have been developed by the UK, along with an agreement to implement all of the 49 CoI recommendations.

“So if there is something in there that differs from what the population wants, how then do we reconcile that?,” he questioned pointing out that what has been agreed to will have to be enforced.

He called on the people of the VI to get together and fight for what they want, rather than having to fight against what the UK is suggesting.

    But this is what the population wants, for the BVI to be cleaned up.
    Question is by who, can we do it ourselves?

    Malone you need to move those old school levels on conversation: when you were the minister for health everything the world said you pushed those recommendations on the people NOW you gone as minister for health all those WhatsApp and press conferences are gone and that COVID 19 talk is now under the rug…….you need to see about the benefits of the people NOW you on the other side of the isle you do not have to dig up trash….13 of you need to fight against apartheid

    Let us get serious and say to Carvin Malone,. " we don't want to hear from you anymore. When you were Min of Health, you knew everything concerning what was good for us. You knew more than Dr Potter, Lady Harmony, Dr George's, Dr Smith,Pickering ,and the rest. Just by getting that ministry ,made you the here.. you were one of those who helped with labeling others as runners with the conspiracy theory. And giving plate of food for taking the vaccines".
    You were the big black cat, wherever you said it was a done deal.
    The UK found out you were cr***00d when they throw the court house project on you ,without having to deal with the government at that time, and here you are trying to get us to have a listening air for you. Noway . No way

    Taken by what the Governor said, “They would not have to go back to the House of Parliament. You asked the question the other day, did you seek to get it off? I would put it to you that even if you seek to get it off, you would not get it off.” We need to fight against that "Order". The only hope we have of rescinding that "Order" is to take it to the United Nation or an international court for human rights violation. The UK can be held accountable because they were one of the signatory that sign off on it. We can potentially have them over a barrel but we're too afraid to open our eyes to see it. Keep in mind that there were suggestions that they were oblige to follow to help us on a self-determining path for which they haven't followed. This can be a can of worms for the self-determination tract. It can cause it to be reexamine in terms of what powers do a former colonial power have over its aspiring self -determining territories.
