UK Foreign Secretary can instruct Governor to suspend VI HoA & Cabinet

LONDON, UK– United Kingdom (UK) Foreign Secretary Elizabeth M. Truss of the Foreign, Commonwealth, and Development Office (FCDO) could at any time instruct the Governor, H.E. John J. Rankin CMG, to suspend the House of Assembly (HoA) and Cabinet, and by extension, the Constitution, should the Unity Government fail to meet deadlines and reform the territory as laid out in their proposal for the implementation of the Commission of Inquiry (CoI) recommendations.

This was revealed by Mrs Truss in a June 8, 2022, FCDO Update on some of the terms of the proposal and the way forward between the United Kingdom and VI, while noting that the people of the VI want and deserve change and have made their desire for better governance clear.

Suspension power on reserve

Mrs Struss added, “We want to support the new government in making this change and allow them the opportunity to reform. The Order in Council will provide the people of the BVI with complete reassurance that change will happen.”

The Order in Council, according to Governor Rankin, was submitted by the UK Government to the Privy Council, and would allow swift action to be taken should the Unity Government fail to meet deadlines.

“If the Government of National Unity or any subsequent government fails to deliver any of the milestones without reasonable justification or I assess that progress is being frustrated in any way, the UK Government and I will take action to protect the interests of people here,” Governor Rankin noted.

Mrs Truss said, the Order in Council will be laid in Parliament, but not brought into force, “Should it prove necessary to do so, I will instruct the Governor to make a proclamation in the BVI Gazette appointing a day that the Order will come into force,” Truss added.

Monthly reports required 

Ahead of any drastic decisions, the Governor and UK Government will monitor implementation and assess progress quarterly where each BVI Government ministry and departments will provide monthly reports.

Meanwhile, although the CoI recommendation had included a proposal for the suspension of the local constitution, Truss said the Unity Government must first be given a chance.

“I believe, in the first instance, the new government should have an opportunity to demonstrate their commitment to reform through the implementation of the 48 CoI recommendations and the further measures they have proposed.

“If it becomes clear that this approach is not delivering the reform the people of the BVI want and deserve we will take action. This may require the swift implementation of the Final Report recommendation,” Truss warned.

Many in the Virgin Islands have accepted that the Unity Government has allowed for direct rule without the suspension of the constitution. Moreso, this was done without public consultations.

    So this Unity Plan will fail, because the BVI Government is not productive at all. The basis of their plan is to meet certain time frames. However we all know, no part of the civil service ever meet any time frame for anything. These government workers do not walk across the same floor twice in the same day or perhaps week. There is absolutely no way, any of those listed mandatory items will be completed on time, or even in the following 3 months. Here We Go.

      Our politicians getting a beaten but I always see office supervision as weak, when you having staff showing up late almost every day, coming to work when they want and nothing is been done..Office management is responsible for honesty, productivity, discipline and fairness..The lack of those things office managers /supervisors have to be held accountable. I always see this as the #1 Issue with Govt.

      Everybody is entitled to their own opinion. We complain about every damn thing in the BVI. Whatever your are hoping for the UK to do or not to do it won't happen. I have lived among these people so I know exactly how they operate. You will soon be replaced in the private sector the UK citizen a start entering.Wait for it!

    It is a case of suspending the constitution without suspending the constitution. It is a constitutional/democratic mirage. The Order in Council suspends the constitution and holds the suspension in abeyance as long as long as VI meets its plan of action and milestones in implementing the CoI’s recommendations. Was this Order in Council discussed, debated, and decided weeks, months ago? Was the local government aware of the Order in Council action all along? How much sway, if any, did the Unity Government’s proposal have on the UK’s decision? Was the decision a fait accompli.

    Nevertheless, it is a win-win for the UK. Their goal all along was to force feed the implementation of the CoI’s recommendations. The Governor has command and control of the implementation. Additionally, the UK is not front and centre in implementation of the recommendations as it would have if it had imposed direct rule. Now, that role and responsibility is delegated to the local government, and if things were to go sideways, ie, public sector layoffs, economic decline, financial structural adjustments, reduction in services delivery, increase in taxes and fees, etc, the finger can be pointed to the local government. The local government has a tough row to hoe. It has 24 months to complete a difficult and challenging project. In other blogs, I suggested rolling out a)zero base analysis, and b)skunk work projects. To this, I add a GOST( Goals, Objectives, Strategies, and Tactics) project/approach for tackling the CoI recommendations.

    Moreover, indications are that the constitutionally due election will occur on schedule. A general election should occur as soon as possible and practical. The campaign for the next general election will be interesting and targeted. Anticipate that much of campaign will be on CoI recommendations implementation since any new government is bound by the agreement between the UK and VI.

      E. Leonard, I agree that a general election should and must be held today! But you and I know that it is not in the Hon Premier Natalio Wheatley and the Unity Government’s (some in the Unity Government may want an election now)interest to call an early election. Some may want to milk being in the HOA as long as possible.

    … has been made. It is UK Statutory Instrument 2022 no. 627. It will come into force immediately as/when the Governor decides it should. The explanatory note to the Order states as follows:
    This Order suspends certain provisions of the Constitution of the Virgin Islands, in particular those relating to ministerial government and the House of Assembly. It vacates certain offices, including that of the Premier, and dissolves the House of Assembly. It makes temporary provision for the government of the Virgin Islands by the Governor, who shall consult (except in prescribed circumstances) an Advisory Council and may establish a Consultative Forum. The Order is to expire two years after commencement, unless it is continued in force or is sooner revoked by a further Order in Council.

    Colonial fearmongering and intimidation at its highest. I understand those who are fed up with the internal failings. However, please do not fall asleep and fail to recognize the potential for oppression when it shows itself. Be careful when we reject our own to embrace others - are we ready for all that comes with direct rule? Be careful what you wish for you just might get it. Remember things like this could shackle us for generations to come.

    Many of our country's natives, and others are trying to lay the blame for our own politicians mismanagement of our finances over a period of years on the UK. This is not true. We have elected the politicians to office, not the UK. Our head politicians have given the official positions of leadership, not the UK. Only after years of mismanagement of our finances the UK decided to deeply investigated and continue investigation of our political misconduct. We need to accept that we have inflicted thes wounds on ourselves,not the UK nor the CoI, but many of us our own selfish greedy mindset.

    The UK have the legitimate right to lead in the defence of our rights rightfully. Only hypocrites, and self-righteous people are in disagreement to the firm stance of the UK to defend us against political robbers of our finances, that has definitely been, and probably still is happening, though on a lesser level in the BVI. since the fall of the former Premier, Andrew A. Fahie, allegedly in accordiling to the USA laws.

    Why hasn't anyone challenge the UK on this entire imposition? From what I read and understand about territories right to self-determination, the UK is violating almost every aspect of what is laid out for them to do. Yet no one has made any challenge, or seek international opinion or see if any of our humane rights has been infringe upon. It's impossible to fight the UK from within their system. Finding a way around the Governor' discretion, the Queen's pleasure and the ability for them to create Orders in Council to fortify their power makes it impossible to get a favorable decision that is contrary to theirs. To make a challenge we must get outside forces with influence who believe in and is willing to support our cause. Negative media attack against them wouldn't hurt either.

    If we learn to treat people as valuable assets in our work places we would see productivity. It starts from the head. Giving employees a listening ear is important. Allowing people to be themselves and proper training every now and again would enhance any firm. Employees being fair and honest with their work place will allow them to get a raise in pay and even climbing the ladder. However we have a number of employees who suppose to be on their job and still want to be on their own personal agenda. Until the government and governor weed out the bad apples the different agencies will not get any better.

    Poor customer service is knocking on every department in the government sector. Until you fix it you will not get value for money.

    On a final note with so many students graduating every year and there is no place to put them both public and private sector what are the government's plans to help to facilitate our young people of the territory with employment?
    Is there a succession plan in place or will we continue to import labour to fill positions when we have a robust human capital in the VI. Whom are not giving a chance in their own territory.
    Think carefully it seems like we do not value our own and pay them their worth but we continue to import, pay high salaries and allowances including paying for housing.

    I really think we are doing injustice to our own people how fair can that be. I'm not here knocking expats I'm just stating the facts. Succession planning is critical to our territory right now and I guarantee you would get value for money when you treat your people fairly.
