Trucker accused of assault; destroying property gets $35k bail
The Court heard that the Virtual Complainant (VC) in the matter reportedly has a common law relationship with the defendant and the two have a 3-year-old child together.
Crown Counsel Tiffany Scatliffe further told the court that the defendant and VC were both at home when they got into an argument on January 15. The defendant then allegedly got up and pulled the mattress off of the box spring causing the VC and the child to fall on the floor. He then allegedly attempted to cover them with the mattress but was unsuccessful in doing so.
The defendant, who also has a trucking business, then allegedly grabbed the VC by her throat and said “this situation is going to end up ugly” after which he told the VC to get their child and go with him to their jeep.
The couple, now separated, then drove to an area in Baugher’s Bay where the defendant apologised to the VC and said he wanted to fix the relationship but the VC allegedly refused and said she wanted to terminate the relationship.
Later on when the VC went to work, a co-worker reportedly saw the marks on her neck, and out of concern, suggested that she visit the Family Support Network (FSN).
On January 18, 2013 the VC went to the FSN and a report was later made to the Police. On the same day the defendant went to the home the couple shared with the intent of packing to move out. While packing, she received a call from the FSN as they intended to pick her up from the home, the court heard.
When the defendant heard the call, he allegedly took up her BlackBerry Bold (valued at $500), hung it up and threw it into the wall, breaking it into pieces. The accused then reportedly took the VC’s laptop and smashed that into the wall as well.
It was at this point that the VC reportedly took their child and ran out to catch a ride on the West End Public Road to go to her father’s home.
Police were later notified by the FSN representative who had called the VC on the phone earlier and reportedly stopped on the way to the VC’s home at the West End Police Station to get an Officer.
Police then escorted the representative from the FSN to the home of the couple but on the way there, they allegedly saw the defendant in an Acura and stopped him, informing him of the offence against him and cautioned him.
They asked about the location of the VC and he reportedly gave a number; when the Police spoke to the VC she informed them of what happened. On January 19, 2013 the accused was told of the complaint of assault and cautioned and he allegedly replied, “I aint do that.”
He allegedly further told the police, “I threw the phone out of the porch over the church… I aint know nothing bout no laptop.” He was then charged with the offence and added that he was saying nothing further.
The defendant was placed on $35,000 bail with one surety and told that he should have no form of direct contact with the VC. The magistrate allowed that he could see their child through a third party.
The accused will return to court on March 15, 2013 at which point he is expected to offer a plea to the charges.

My advice to Kimbal would be to move on and remain a part of your child's life in every possible way. Relationships fail everyday and you just have to pick up the pieces and move on while taking this experience as a lesson. Lastly, make it the last time you use abuse as a weapon. Try loving instead of hurting.
Kids are rebuked for throwing tantrums as a means of getting their own way. Many men resort to abuse to achieve the same ends.
my advice to you kimball is i hope you learn from this bad situation and turn it into a good one. you ain't the first and you ain't going to be the last. instead of abuse treat the situation with love better yet seek counseling or walk away from anything that will cause you to loose your cool mind over matter
