Trini found guilty of raping minor

ROAD TOWN, Tortola, VI – A Trinidadian was unanimously found guilty of rape and indecent assault when his trial wrapped up yesterday afternoon Monday, November 7, 2011 in the High Court.

To this end, John Bally, who committed the sexual acts on a girl under the age of 13, is remanded to prison until his sentencing hearing on December 5, 2011 before Justice Indra Hariprashad-Charles.

Bally has been living in the Virgin Islands for 15 years.

According to court records, the first act occurred sometime between June 14, 2005 and June 14, 2007 when the virtual complaint (VC), said to be between eight and nine years at the time was resting at Bally’s apartment.

The VC knew Bally, 48, since he was renting an apartment belonging to her adoptive parents.

According to testimony from the VC, she was awaken by someone kissing her on the lips and realized it was the defendant, who subsequently proceeded to have sex with her.

As for the indecent assault, Bally had allegedly placed one of his hands on her private part while she was in a vehicle waiting for her parents. That incident happened between June 14, 2009 and April 28, 2010.

Prior to being found guilty, Bally was on bail. He was represented by Herbert McKenzie of Orion Law Firm.

    Just as I said before, if anyone but a BVIslander commited a crime like this, he would be guilty of raping. Bring that Sea Cow Bay boy next to him, and we will drag both of them through town, then take them way out to the fishing hole, & lettum walk back. Sea Cow Bay boy, you are even more guilty, that wuz your daughter. What kind of brain you got in there! WOW

      So what you are saying is that someone can come to the BVI, commit a crime and their punishment should simply be for them to be sent home? I hope that you dont work in a position where you have to make decisions as clearly you are unable to think rationally. BTW - curfew has been listed - its the start of carnival season down there!
