Trial for "Crash" likely in July, 10 witnesses to be flown in
The trial may commence in July, as according to Principal Crown Counsel Tiffany Scatliffe who was addressing the Court yesterday May 1, 2012 when Allen who is charged with death by reckless driving made an appearance, July is the time when most of the witnesses indicate they would be available.
According to Scatliffe, of the 12 witnesses to testify, 10 are from overseas and so far, the investigating officer is still awaiting confirmation from four of them. She told the court that she would like an opportunity to follow up on the matter while the arraignment for Allen was set for May 7, 2012.
She also disclosed that some of the testimonies could be done by video link as well.
Allen was allegedly behind the wheel of the tour bus that overturned on Windy Hill on February 23, 2010. It resulted in the death of 24 year-old Aaron Rumphrey of New York. Six other passengers were treated at Peebles Hospital and released.
A Police press release issued at the time of the incident had stated a total of 20 cruise ship passengers from the Caribbean Princess were on the tour bus descending the Windy Hill Road when the driver struck an embankment and the vehicle overturned.
Of the 20, 13 passengers were assessed at the scene and taken directly back to the cruise ship.
At the time, Allen was granted bail in the sum of $60,000 – $25,000 cash and $35,000 signed surety. His driver’s license was also suspended, but he landed back in prison after being charged for sex related offences. He is currently serving time for those offenses.
