Time to ‘turn a new page’ on multiple bill readings in one sitting– Hon Fraser

PASEA ESTATE, Tortola, VI – Senior Legislator in the Virgin Islands House of Assembly, Hon Julian Fraser RA (R3) has blasted legislators and Premier Dr the Honourable Natalio D. Wheatley (R7) for what he referred to as the rushing of bills in the House, with often three readings on one day.

Hon Fraser was at the time speaking at the Continuation of the Eighth Sitting of the Fourth Session of the Fourth House of Assembly on November 24, 2022, at the Financial Services Resource Centre, Jones building, in Pasea Estate, Tortola.  

“This first, second and third reading thing, I trust that the Premier has really and truly seriously re-considered the practice,” he told the House during the debates of the Insolvency Amendment Act 2022. 

Hon Fraser added that there is no rational expectation to call a sitting and pass a bill the same day. He added that even though the current premier has met the system that way, it is one that should change. 

According to the legislator, bills require meaningful discussions and that cannot happen once a bill is rushed, especially bills like the one that was being debated.

The senior legislator noted that for bills like the Liquor Licensing Act, there are consultations; however, there is none for a bill relating to financial services.

He further questioned whether the House thinks people could only relate to bottles more than finances. 

In a House of Assembly sitting on October 18, 2022, the Junior Minister for Trade and Economic Development Hon Shereen D. Flax-Charles (AL) warned against last-minute emergency bills coming to the HoA.

She said while more persons might have recommendations for the bill, those recommendations cannot be taken if the bill is rushed. The bill in that case had emanated from the Deputy Governor's Office.

"I don't like it, and we have to change the way things are being done in this house," he added.

    The problem is not three ‘readings’ on one day but the fact that to members of the HoA don’t even read them once!

      No, not at all. He had the potential a few years back but not at this time. Some may agree with me and some won’t for whatever reasons but I will say it sans it is my opinion. Fraser is getting up in age and he should step aside and let the younger ones that is trying to get into Politics have a chance. We need new younger blood. Regardless of what you may say or think about the now Premier, he opened the door for the younger ones to get in.

      Fraser is arrogrant but he will make a good Premier. He has had a chance to observe the good, the bad and ugly. He has experience of bad, poor performance. Definitely the Liberator is prepared and ready.

    Saved for genuine emergency legislation, bills should not be rushed through HOA, ie, 3 readings in 1 sitting. As such, legislators should have access to propose legislation at least a week prior to it being debated in the HOA. Legislators should used the time to peruse the proposed bill, consult with their constituents, conduct research, etc. At the HOA, members should be given ample time to debate and discuss the bill. The VI is a representative democracy, ie, the people elect members to the HOA to represent their interest. And legislators must be committed to effectively representing their constituents’ interest and should be given the time to do do in a timely manner. Seeking political office is a commitment and promise to constituents that their representatives will put their interest first and foremost and will dedicate the time, energy, etc to deliver the best and most practical representation. The quality and clarity of legislation should not be slaughtered on the altar personal convenience. PEOPLE interest first. Further, legislation passed in the People’s HoA should be respected and honored, ie, one person the Governor should not have the ability to kill it. Mount Olympus cannot be a graveyard for bills that the crown don’t like. If a bill get to Mount Olympus, means that it should have been already properly and effectively staffed. CRC needs to negotiate a democratic process for resolving assent road blocks. Not assenting to bills in the U.K. is a rarity, eg, the last time a bill was not assented to was in 1707 under Under Queen Anne. It was the Scottish Militia Bill.

      Leonard, bro, now you know that these elite members will not even show to HoA meetings on time and don’t want any extended meetings. They want to get things completed in quick time. Handling 1 reading per sitting will cramp their style and inconvenience them. 3 readings in 1 sitting seems a bit much. In order to properly vet a bill, will require discussion by members and people input, etc.

    Another thing. The government should have a cut-off time for these sittings. Why can't these meetings start on time and finish at an appropriate time? How can you all sit from morning until late 11 o'clock and beyond in the night just talking, talking, all kinds of things that make no sense just to pass a bill? It is ridiculous. This practice has been going on for years and it needs to stop! I watched this last sitting the other night and I saw the Speaker's eyes looking tired and puffy(also bags around her eyes), and I felt for her! The time of sitting also needs to be changed for the upcoming year. I was listening up until minutes to 11 p.m. The next thing I knew, it was morning! It's Just ridiculous! TIME FOR A CHANGE IN THE ORDER OF THINGS IN THE HOA!

    I can't believe if members are unhappy with how the bills comes to the House and they can't do anything about it.
