‘The Speaker can’t remove Fahie’- Dr Kedrick D. Pickering

VALLEY, Virgin Gorda, VI- When Speaker of the House of Assembly Corine N. George-Massicote refused to accept leave of absence from First District Representative and former Premier Hon Andrew A. Fahie, it led to anticipation that Hon Fahie would lose his seat and there would be a need for a by-election.

Former legislator Dr Kedrick D. Pickering; however, has suggested the Speaker has made an error, claiming there is no mechanism in the Constitution or the HoA Standing Orders to remove Hon Fahie from the HoA.

‘No legal mechanism’ to oust Fahie- Dr Pickering

Speaking during a community meeting at the Virgin Gorda Yacht Harbour Parking Lot last evening, November 2, 2022, the declared At Large candidate for the upcoming general elections said there was never going to be a by-election in the First District.

“There could have only been an election if the elected Representative for the district resigns. If he doesn’t resign they can’t remove him, don’t mind what you hear. There is no legal mechanism for recall in this country. The only people who could remove the elected representative is the people who voted that representative in.”

According to Dr Pickering, the constitution does not make any provision for a situation like Honourable Fahie.

“All that talk that you heard about they are going to have meetings in the House of Assembly and they are going to have three consecutive meetings and then Fahie will be voted out, it was never going to be possible.

“All of a sudden they realise it was just a lot of talk, because the Standing Orders of the House of Assembly are rules and regulations that have been established by Members of the House for themselves. The Standing Orders are put there in place to ensure members of the House conduct their business,” Dr Pickering declared.

Did Speaker err in rejecting Fahie’s leave of absence?

According to Standing Order 84 of the principal Standing Orders of the HoA, “A Member of the House shall vacate his seat, if the Member in any one Session is absent from the House for more than three consecutive sittings without the written leave of the Speaker.”

During the start of the Fifth Sitting of the Fourth Session of the Fourth House of Assembly at Save the Seed Energy Centre in Duff's Bottom, Tortola on July 19, 2022, Speaker George-Massicote denied Hon Fahie Leave of Absence from the HoA for that Sitting, along with the Sixth and future Sittings of the House under his current bail condition in the United States.

According to Dr Pickering; however, the Speaker has no authority to deny Hon Fahie leave of absence.

“The Speaker of the House only has one responsibility, to look after Members interest. The Speaker of the House can’t put out a Member. The Members can put out the Speaker because the Members put the Speaker there.

“So there was never going to be any way they could remove Fahie because he did what he had to do, informing the Speaker that he was going to miss the House sitting. The Speaker can’t determine whether she accepts or he accepts what the reason is. The rules clearly just simply says you have to inform the Speaker at the appointed time that you are not going to be attending the meeting. So there is no legal mechanism for removing the Member for the First District. Don’t mind all that talk.”

Dr Pickering reiterated that there was never going to be a by-election.

“We have a general election coming up and that is what we must concern ourselves about because it is going to be one of the most important elections in this country,” Dr Pickering stated.

    Good points doc. I did ask myself that. Whether the speaker has a right to deny requests for granting of leave, whether reasonably or otherwise.

    Standing Order 84 of the principal Standing Orders of the HoA provides that “A Member of the House shall vacate his seat, if the Member in any one Session is absent from the House for more than three consecutive sittings without the written leave of the Speaker.” The word "leave" in the legal context means "permission" so the Member requires the written permission of the Speaker to be absent for more than 3 consecutive sittings. If the Speaker's function was as Dr. Pickering suggested, Standing Order 84 would have only required the member to notify the Speaker of his absence, and it would not have required the Speaker's permission. Based on the wording of Standing Order 84, if the Speaker does not give her written permission for the absence, and the Member is absent for three consecutive sittings then that Member shall (i.e. MUST) vacate his seat.

    Very Interesting and contrasting piece information in regards to the topic issue brought forth by former NDP Deputy Premier, Dr. Kedrick Pickering. He has been on power for 20 years, the present Speaker of the House lest than a year. The general public needs to be further education on this critical issue at hand.
    Helping to educate the public on an issue such as this one is a vital necessity to achieve better governance in present and future BVI political representation of our people's rights by political leaders, in mine, many others opinion.

    Pico missed this one. The fact that there must be written permission implies discretionary power of the speaker. It didn't say"unless the speaker is informef in writing.
