Smith siblings remanded to HMP for harbouring Jose Almestica

ROAD TOWN, Tortola, VI- Senior Magistrate Tamia Richards remanded two more persons – Shamal Smith and Renee Smith – to Her Majesty’s Prison, charged with Harbouring former fugitive Jose Almestica.

“The defendants are remanded,” the Magistrate said following the Zoom court hearing held on Tuesday, December 14, 2021.

Bail denied for Renee Smith 

She said the attorney for the duet, Mr. Stephen Daniels can choose to make a bail application for them at the High Court, however, she felt that the aggravating factors in the case were against them, and she denied them bail.

She said she did not accept that the location where Renee was found was in the hospital parking lot as is being argued by Defence Attorney Stephen Daniels.

Ms. Smith works as a cashier at the BVI Health Services Authority (BVIHSA). The police received a tip that she was attempting to flee from the territory and went to investigate. 

Upon their arrival, Smith was found in the parking lot across from the Road Town Ferry Dock where the persons conduct their car washing business.

In her company was her mother, who also happened to be in possession of her passport.

She was arrested and later charged with the offence of Harbouring a Prisoner and when interviewed, denied the allegations put to her.

A search warrant was executed at her home in Hannah’s Estate and the police found rent receipts and a rental agreement in her name for the three-bedroom house in Ballast Bay that Mr. Almestica was residing.

The Magistrate said although Ms. Smith’s income at the BVIHSA was $1,800 she would pay Mr. Almestica’s $5,550 rent most times in cash, which meant that she has access to cash resources outside her normal earnings. 

The court also stated that the prospect of fleeing the territory to avoid coming to court and facing a possible conviction, especially Shamal who was a USVI native with BVI belonger status, they could easily leave, with the border being so porous.

Brother charged with same offence  

Mr. Smith was charged with the same offence as his sister because the police investigation gleaned that he visits Almestica’s home, and he told the police that they met in 2020 and became friends.

Mr. Smith admitted that he would run errands for Almestica and he knew he was a fugitive.

At the time when Mr. Smith was arrested, household items similar to those seen at Almestica’s home and documents relating to motorcycles that were located at Almestica’s home were found at Mr. Smith’s home.

During the Police raid of Almestica’s home, they found large quantities of firearms, ammunition, cannabis, cocaine and two motorcycles.

The matter was adjourned to February 2, 2022, for report/paper committal.

Just last week, the court denied Jennifer Smith of Sea Cows Bay bail for the same matter during the arraignment hearing with Almestica and ordered that they be remanded to the prison.

      Tortola is a lawless Country. The locals do whatever they please and get away with a whole lot of things. The locals is the ones responsible for the illegal drugs and guns coming into the Country. They make the rules.

    What is it about this guy that all of this crooked family put their lives and freedom at risk? This entire family is dangerous and needs to have the longest prison sentences that can be given. The mother and her baby crew are wicked beyond belief. They paid that much rent per month to let him live lavishly means he was responsible for a whole lot of dirty money coming their way and probably responsible for some of these murders. No bail for them because as you can see...they were going to flee.

      Don’t hide behind a Lawyer and expect the Lawyer to get you off on a serious crime by harboring and assisting a fugitive from the law for 4 years. In America, they would be facing at least 20 years in CLUB FED. That is a very serious crime.

    Another young woman toss her whole future down the drain. Was it really worth it? To you young ladies, build a positive future for yourselves.     You have to start at the bottom to make it to the top. I have much admiration and respect for the young women in the BVI that take pride and decency in themselves by doing positive things. I would give a young woman props and encouragement if she is at the side of the road cleaning and selling fish to make a honest dollar.

    Seems to be the culture of the BVI is to hide criminal behaviour. Still no one comes forward with information about the killing of the young girl out West. Now a whole comunity hiding an escapee for 4 years so he can carry on trading drugs and guns. What a society. Very depressing.

      That is exactly the culture of the BVI, HIDING AND SWEEPING CRIMINAL BEHAVIOR UNDER THE RUG. The BVI is a lawless society. The locals do as they pleases. Soon all visitors is going to stop visiting. Why do you think most of the locals leave and never look back.

    Puzzles me how a mother who is suppose to be a positive force in their children’s lives teaching them RIGHT from Wrong is upholding wrong, covering up and condone the wrong doings of their children.     What this family did is a very serious crime indeed. Others need to pay attention as there are others hiding information on murders because it’s their family members that are the perpetrators.     Was it worth it? oh can’t read this post because your locked up and have no phone!! Hope this hits home for other people in the BVI that’s about the fast illegal lifestyle. The post are nice the glamour is nice but sitting behind of bars??? That’s not nice. The BVI people have proven that living beyond their means even if it’s from drug money is Ok… It’s Not okay.
