Sex offender Andre Penn loses Appeal
Penn was tried and found guilty of 11 of 12 counts of offenses most sexually related, committed against a young girl.
On November 23, 2016 however, the Court of Appeal also did not rule in his favour and ordered that all the decisions handed down in the High Court by Justice Dearshan Ramdhani be upheld.
High Court Decision
On the seven counts of indecent assault, Justice Ramdhani had imposed a 3-year sentence each, on the one count of unlawful sexual intercourse with a girl under 13 years he got 8 years and on the two counts of buggery 4 years each.
The judge then ordered that the three categories of the sentences run concurrently, which put the total years to 15.
Justice Ramdhani had also stated that in law he had to consider the number of years the trial hung over the head of the defendant, Penn, and as such he reduced the time to be spent by 5 years. One year was deducted from the combined seven indecent assault sentences, three years removed from the unlawful sexual intercourse against a girl under 13 years of age sentence and one year was removed from the combined two buggery sentences.
