‘Rogue public officer’ Najan Christopher charged by police

- charge stemmed from diplomatic note sent from Premier’s Office following Hon Fahie’s arrest

ROAD TOWN, Tortola, VI- Director of the International Affairs Secretariat Najan Christopher, who was described by Premier and Minister of Finance Dr the Honourable Natalio D. Wheatley (R7) as ‘a rogue public officer’ has been charged by police for Breach of Trust and False Assumption of Authority.

This was confirmed by the Royal Virgin Islands Police Force (RVIPF) today, October 11, 2022.

The RVIPF said Christopher, who was sent on leave pending an investigation, was arrested and charged yesterday, October 10, 2022, and granted bail in the sum of $5,000. She is to appear before the Magistrate's Court on November 30, 2022.

Police said Christopher’s charges stem from the diplomatic note sent from the Premier's office.

Background

On the request of former Premier of the Virgin Islands Honourable Andrew A. Fahie (R1), who was arrested in Miami, Florida on April 28, 2022, for alleged cocaine trafficking and money laundering conspiracy, Ms Christopher wrote and signed a letter stating that Hon Fahie at the time of his arrest was the Head of Government of the Virgin Islands and therefore immune from arrest.

The letter by Ms Christopher was later disavowed by Honourable Wheatley and also rejected by a US court.

The letter, dated May 3, 2022, which carries the letterhead of the Office of the Premier and is stamped by the International Affairs Secretariat, appeared to endorse the former Premier's argument for diplomatic immunity. 

When the letter was leaked to the press, then-acting Premier Wheatley noted that both himself and Dr Carolyn O’Neal-Morton, the then PS, were unaware of the correspondence and blamed it on a “rogue public officer”.

He also noted that the "rogue public officer", who was later identified as Ms Christopher, would be “investigated” and that the letter did not reflect the position of the Virgin Islands Government.

It is our understanding that when questioned, Ms Christopher said at the time she dispatched the letter Honourable Fahie was still the Premier and she was in her right to take instructions from the Premier.

She also noted that both Drs Wheatley and O’Neal-Motion were not aware of the letter before it was dispatched.

Ms Christopher is the daughter of the late Fifth District Representative Delores Christopher.

Meanwhile, Premier Wheatley announced at a recent press conference that Police Commissioner (CoP) Mark Collins was being investigated over the ‘Police in Paradise’ video that Governor Rankin labeled as “inappropriate”. However, unlike O’Neal-Morton and Christopher, the CoP remains on the job.

Racism & double standards?

There has been no word on the status of the investigation or why he remained on the job and if the police are investigating themselves. Many residents and talk show hosts have cried foul and labeled the situation as double standards, injustice, and racism.

Mr Collins had said he got clearance from the BVI Tourist Board (BVITB) on the video; however, BVITB publicly denied any involvement in the video projecting the Territory as crime-ridden and a violent place. 

Collins claimed it was a recruitment video for officers to join the Royal Virgin Islands Police Force (RVIPF).

          I'm sorry that it came to this. Intelligent people need to use their good sense and good judgement when in a jam. All she needed to do was say "no". I think her supervisor is just also at fault but she cannot use that as an excuse for her own poor decision. She is an intelligent person. Not a stool pigeon.

    Overall this young lady is a good person who made a very bad decision. She said she made the now Premier and Permanent Secretary aware about the note she was sending. But they did not stop her nor did they say go ahead. So they left her to hang herself. Her bosses are just as guilty. Fired yes but not arrested. Very sad position.

      … but hold up she is not a regular good person - she was a trained officer who should know to consider the law at all times when taking action. So frankly not just bad decision - it is far worse and demonstrates a disregard for the law and doing the right thing - you cannot gloss over that. Morally this speaks volumes. I wonder what we all would have done given the same circumstance and I suspect many would have done the same. BVI has been lawless for so long people don’t even think what she did is that wrong from the comments. Even Premier (if he knew) stayed silent. And this is the point we need to face into.

      You say fired but not arrested.. Are you talking about the lady who is the subject of this article? If so, my reading of the article is that she was arrested, charged with 2 offences, granted bailed and is on leave pending investigation. This means they have some substantial evidence. Whether it sticks or not is another matter.

      @suspect. I don't think it'is suspect that she is saying they were aware. I think when she told them they didn't know what to do. If anything went wrong they didn't want it bounce back on them.Self-preservation mode. So they left her out to dry. Those two were very close allies of Andrew but when the sh*t hit the fan they were about saving themselves. The young lady wasn't sharp enough to see that. I have heard many say this Premier lies alot so he probably knew.

        @pity, i think you have a good read on the situation, but I think it reflects very poorly on the two. Were they aware as she claimed they could have spoken earlier to stop her and not embarrass the country or speak more quickly instead of wasting everyone's time with an investigation.

        I love your analysis’ of the event. I know from a diplomat fact that when heads of government get arrested, two persons are first notify. The premier’s office/ President Office/ Prime Minister Office or in such case the governor office and the Premier’s Office, the Foreigners Sectorial office then sent a letter of confirmation or denial. In some country who rule with the dictatorship method that country would confirm that the president or prime minister is still the head of government . In this case all of the Officer in the premier office would know, as the rule of thought is that the foreign secretary will in form the next in charge which is perhaps the PS and that person will inform the next person who is the acting Premier. In this instant of British rule the governor would be told first that the head of government has be arrested, he will then call a meeting with the acting premier, who will notify the cabinet members of the event. I think I might leave out a bit but feel free to add or take away from this dialogue. I will love to see the result of this arrest and charge of Ms Najan.

    This young lady is being used as a scapegoat to drive fear into the general population. This is one of the oldest tactics of the colonial regime. You foolish virgins can go on fooling yourselves but the longer it takes for you to wake up to reality the deeper down the rabbit hole you will find yourselves. All Virgin Islanders need to take a stand now if you are to remain relevant in your country. It's a pity so many are totally clueless while being played by others whose only interest is what's in it for me. We are selfish we all want it for a small group and we have original premises in bvi with nothing to one if debts others live well.     We could understand the young lady thinking that Mr. Fahie was still in his official position since a new premiere had not been announced. Even if the two named officials knew about the letter and did nothing that's OK because you were still under the supervision of mr.fahie.

    If anyone should be charged it ought to be the person who requested and authorized the action. If this lady's story is true then she'll be OK.

    I do not see any motive, intent, anything if she was following orders in the regular course of her employment. Why are they charging her as a criminal especially if she may have felt pressured to follow instructions or if she was not guided to do otherwise once she informed others. Prosecution cannot prove elements of the case. There is no supporting evidence to suggest Ms Najan has bad character or anything of the sort. It should be a 'no case to answer' submission. Then she should drag the powers through the mud for defamation.

        Who gave her the title of rogue officer? By speaking it, it becomes slander. By writing it, it becomes libel. She held a senior position, did she not? Her name is being dragged through the mud is it not? Potentially by people she may have notified about the request who knew she was acting under instructions and did not tell her 'no' - allegedly. So they knowingly make false statements to label her as ''rogue ' without believing in the veracity of the statement. She has suffered damage to her name, her image, her source of earnings, perhaps suffered a great deal of distress in the process. Not to mention that this public labeling is likely to prejudice her case and may question the fairness of any trial where she deserves justice. I hope she comes out victorious and sues everyone who is behind her destruction, whether it be to destroy her name and reputation (defamation) or otherwise just because they needed someone to blame. So it goes in this little village.

    This lady did nothing wrong, she acted in her capacity in a very tight time sensitive situation. If she did not write that letter he would have been treated only by his name and not his office at the hearing that was schedule to happen shortly and every other hearing about hereafter. Andrew’s lawyer is who requested that information.

    But make no mistake, this is psychological warfare on the part of the UK. The Premier should NEVER have use those words “Rogue Officer” until he had all the facts. Those of us who truly care about our country please be on red alert. Our entire future is at risk here.

      She lied in a letter regarding Fahie’s status AND due to the COI, Fahie’s office under investigation, and sensitivity of the matter HAD NO CALL sending it WITHOUT consulting the Governor.

        Diplomatic immunity is an agreement between two parties. She couldn't have created or initiate any immunity status by sending a letter. So, the question is was there a crime committed and under whos authority was the letter sent. If Mr. Fahie was still the legal Premier she may have been within her rights.

    I was not writing or sending that letter without permission from the Governor. The Governor would of had to gave me permission in writing. The former Governor already made a remark stating that politicians are into drug running so I was not affiliating myself with Fahie, especially anything to do with USA. The bait was set...

    The fact of the matter she made a bad judgement call. She wasn't set up or left out to dry she made a bad decision. For something of the magnitude as intervening in a criminal matter especially when nobody had all the details as to what was going on and without verbal discussion or confirmation on the way forward she screwed herself. She's a good person at heart but she's also a difficult person who has a problem with authority because she's an antsy know it all.

    I fully understand the nature of the problem that has been created by the conduct of the local people. There is however an other side to the problem which the majority of locals do not and many cannot recognize. You are watering a tree that will be very difficult to uproot when it bears it's toxic fruits. I wonder how many truly understand the gravity of the situation and the implication not only for the Virgin Islands but for the entire region. Stop player hating and look deeper at the implication for a people who have been robbed of their very soul. King Paido say "They Coming Again." Seriously if we can understand why the United States purchased the USVI from Denmark at the beginning of World War 1 then we will have an idea of why the Virgin islands are once again the focus of attention at the beginning of World War 3.

    I wonder why Andrew didn’t ask the Acting Premier (Dr. Wheatley) to write that letter? After all, he would have known whether the then Premier had diplomatic immunity. I know it’s rather too late now, but Andrew really got this young lady caught up.

    I pray that she’s able to get out of this, if she acted under a mistaken belief based on what Andrew instructed.
