PS O’Neal-Morton files Constitutional Motion against Governor & others

- Motion also filed against Attorney General, Public Service Commission & Director of Human Resources

ROAD TOWN, Tortola, VI- Many residents will remember that the Permanent Secretary in the Premier’s Office, Dr Carolyn O’Neal-Morton, was sent on leave weeks after the arrest of former Premier Andrew A. Fahie.

There was no relationship between Mr Fahie’s legal struggles in the United States and Dr O’neal-Morton being sent on leave.

It was alleged that she was not cooperating with the Auditor General, which Ms O’Neal refuted.

Dr O’Neal-Morton alleges violation of her rights

Dr O’Neal-Morton then hired high-powered attorney and former Director of Public Prosecutions (DPP) in the Virgin Islands, Mr Terrence F. Williams, to file a Constitutional Motion about six to nine months ago for sending her home without proper reason and the violation of her human and civil rights as guaranteed in the Constitution of the Virgin Islands.

The hearing was held yesterday, November 20, 2023, in the High Court where the Attorney General filed a Motion to strike out the Constitutional Motion brought by Dr Oneal-Moton through her attorney.

Judge’s decision pending

Judge Sonya Young did not agree yesterday to strike out the motion but said she would come back with a judgment on December 20, 2023.

Efforts to reach Mr Williams for comment proved futile.

The Governor and others have been flooded with lawsuits following the one-man Commission of Inquiry Report by a UK Commissioner hand-picked by former Governor Augustus J.U. Jaspert.

Following the CoI, many public officers were accused of Breach of Trust but no concrete evidence was presented.

Many of them were sent on leave and they have been suing the Governor, along with the Public Service Commission, and the Director of Human Resources for violation of their rights and mistreatment.

Dr O’Neal-Morton has joined a long list of others who have the Governor and others before the courts.

We will bring you more information when the judge gives her decision on December 20, 2023.

    Every time this Governor wakes up on the wrong side of his royal bed he threatens to suspend the constitution but it seems like he already suspended it in his head because there is constant breaches of it from him and his people. I guess we should look out for more breaking news of breaches from others soon.

    FYI the legal term is not lawsuit because there is no conflict. The action is simply an inquiry application.

    The BVI taxpayers cover almost a 100% of the UK--appointed Governor’s tropical vacation governing expenses , viz, housing, domestic services, food, entertainment, transportation, travel, telecommunications, etc. This is parasitic behavior and is definitely crusading, ie, the people are paying to be ruled and oppressed. The UK covers his salary.

    There seems to be a number of cases filed against Governor John. Rankin, CMG, and pending. The Governor is winging off soon into retirement. Consequently, if the courts ruled against the Governor and if monetary judgement is assessed, who pays , ie, BVI taxpayers or the UK? Is it not easy for officers to make reckless, experimental, deliberate and unnecessary risks, not sensible risks, actions, for they’ve will not be held responsible and accountable for their actions?

    . It is open secret that that the UK- appointed governor can take any action(s) against locals, and local government personnel, but the ordinary local people, and government officials have no means of redressing concerns with the governor and Governor’s office. There are modes on paper , ie, FCO, but they are as useless and a waste of time as tits on a boar hog. The governor has veto power, unilateral power, reserved powers, power of assent, etc, over local actions.

      @The watchdog, yeah, Governor John Rankin, CMG,( 1921-Present) had a good run deploying and implementing the evils of colonialism, demonstrating tremendous veto, unilateral, racial superiority, etc, power over the people of the BVI, depriving them of basic human rights, the right to self/governance, etc. Colonialism is the demonstrating of a superior/stronger power, ie, military, administrative,,etc, over a weaker power, not necessarily a smaller power. Evil is evil whether it is performed by snakes in the grass or by murderous dictators. Administrator John Augustus Cockburn ruled the BVI with an iron fist, thumb on the scale, and according to the old heads he was a terror from 1946- 1954. His roll was slowed by the Great March of November 1949 which was led by Anegadian fisherman Theodolph Faulkner. Where has all the bold, courageous , etc Dolph Faulkners gone??All we have now are opportunists and Neville Chamberlain-like appeasers . Which John was worst, ie, Administrator John Augustus Cockburn Cruikshank or Governor John Rankin or Governor Augustus James Ulysses Jaspert?

    If governor ranking and the psc are doing this type of violations to a per sec, a sitting member of the house Myron, a commissioner of customs, etc etc then what about the little man?

    It clearly shows a disregard they have for the rule of law, residents rights and due process!!! Our independence is the only way out of this oppression

    When Attorney General ,HILTON GAYLEwas here andshe accused the then Governor of Corrupción., as he receive the Summon document, he ordered and signed her deportation papers and had her out of here immediately..
