Pemberton gets 1 year for gun & explosives
Represented by Stephen Daniels, it was put forward to Magistrate Valerie Stephens that upon the defendant’s guilty plea, he apologised for his actions and asked for justice with mercy.
Mr. Daniels, who continued to speak on behalf of his client, who is the father of 2, stated that if custodial sentencing fits his punishment it should be at the lower end of the scale.
In addressing the court, Mr. Daniel said that no evidence was formed against his client in relation to if the weapon was used or if he had any criminal intent to use the weapon.
The charges against Mr. Pemberton were: Possession of Fire arm, possession of explosives and possession of cannabis.
Magistrate Stephens, in taking into consideration all that was put forward to the court by Mr. Daniels, discharged the charge of cannabis put against Pemberton.
He then received his sentencing of 12 months on fire arm charges and three months on explosive charges to run concurrently from the date of remand.
It is alleged that Pemberton was stopped in Duffs Bottom on the evening of February 20, 2010, where a .380 pistol and seven matching rounds and eight grammes of cannabis were found in the centre console of a rental vehicle. It was alleged that .9 grammes of cannabis was also found in the defendant’s left rear pocket.
