Nikita H. Naval pleads not guilty stealing cellphone
In reading the allegations against the accused Prosecutor Herbert Potter told the court that on July 31, 2014 the virtual complainant visited the Festival Ground when she placed her cellphone along with other documents in the tray at the security hut and on reaching the other side of the security hut the items were all gone.
The court heard that subsequently she used her iPad to track the phone which pointed her to the home of the accused. It was reported to the police and upon visiting the accused's home he was confronted and in turn handed over the phone to the police while saying, “I should have thrown it away,” alleged the prosecution.
He was taken to the Road Town Police Station. It was on August 15, 2014 that he allegedly told the cops that he had found the phone on the ground but had no knowledge of the other items including $100.
The court heard that the security guard refused to give a statement in the matter which prompted a response of surprise from the Senior Magistrate, Ms Tamia Richards as she said, “Oh really,” and advised Mr Potter than he needs to furnish himself with the name of the security firm that was in charge of the gate at the time. Mr Potter hadn’t such information in court.
Naval was placed on $20K bail with one surety which his mother did on his behalf and who he told the court is out of a job.
He was banned from playing football after 5:00pm as the Magistrate ordered that he heads straight home after school every day until matter is over. He was placed on curfew from 5:00pm to 7:00am daily.
