ROAD TOWN, Tortola, VI- Word reaching our news centre from sources within the National Unity Government is that Director of the International Affairs Secretariat Najan Christopher has been identified as the public officer who prepared the letter from the Premier’s Office that purports to endorse former Premier Andrew A. Fahie’s notice to a Florida Federal court that he is immune from arrest.

The letter was later disavowed by now Premier and Minister of Finance Dr the Honourable Natalio D. Wheatley (R7).

The letter, dated May 3, 2022, which carries the letterhead of the Office of the Premier and is stamped by the International Affairs Secretariat, appears to endorse the Premier's argument for diplomatic immunity.  

The letter was requested by the former Premier’s Attorney, Theresa Van Vliet.

Dr Wheatley said at the time the letter was issued he was in the House of Assembly and Permanent Secretary in the Premier’s Office Dr Carolyn O’Neal-Morton was at her desk “attending to her normal duties”.

The now Premier noted earlier this week that both he and Dr O’Neal-Morton were unaware of the correspondence and blamed it on a “rogue public officer”.

He also noted that the "rogue public officer" would be “investigated” and the letter did not reflect the position of the Virgin Islands' Government.

It is our understanding that, when questioned, Ms Christopher said at the time she dispatched the letter Mr Fahie was still the Premier and she was in her right to take instructions from the Premier.

It was only yesterday, May 5, 2022, that a motion of no confidence against Mr Andrew A. Fahie was passed in the House of Assembly, stripping him of the Premier's title.

When reached by our newsroom, Ms Christopher said: “I do not wish to comment.”

        This woman has no morals. Fahie is in prison for alleged drug trafficking, bribery, and money laundering (not to mention destroying the reputation of the territory and attempting to sell it out to drug lords) and she takes it upon herself to write a high handed letter demanding his release.

        She did not consult the attorney general, did not consult the permanent secretary, did not consult the acting premier, did not consult the governor. She is either a fool or equally corrupt.

        She should be dealt with appropriately.

        A person is presumed innocent until proven guilty. I don't know about everyone else but this whole thing makes no sense to me, because no one has to diverge information to any dealer and I am not a drug dealer, cartel member or any other thing for a matter of fact and I know this from watching documentaries, but....this is all surreal and yet dumb.

            When asked to respond to correspondence such as this, it must first go through the Permanent Secretary for directions. She was practicing outside her scope and some of the information that she gave in the letter was also erroneous. The office if the Governor should respond to any issue pertaining to diplomatic status

      @ hmmm, I do not want to get into who`s right or wrong, But who made the call to have this document sent? Who received the call? Was it the Client, or the Lawyer? All the fuss is about who it will help, but not who it affects.

        Ms. Christoper is the International Affairs Secretariat of the Premier's Office , a high level position from even prior to 2008 when I was there. The former premier was ousted yesterday 5th May her letter was written on 3rd. In that regard it was a letter legally written, though morally questionable .

          This woman did not break any law and she probably didn't break any protocol either. However, as a high level public officer you need to have a higher level ability to recognize a questionable request even if legal. She should have submitted/ received approval from the permanent secretary. You can't have rogue public officers in such high positions. It's bad enough we have to worry about our elected leaders.

    This is aa criminal offence, she was out of order, breach of trust. She didn't have the authority to sign such letter must less demand his release.

      Before you implicate innocent people, do some research. Think, by law AF was still legally the Premier and his lawyer reached out to the diplomatic office for confirmation. If that this lady is the head of that office she technically did nothing wrong. AF was the still the Premier at the time so he was still the boss. Think!

      If just like you going to the bank for the loan and you disclosed you are employed by AF and the ask for employment letter and call AF for confirmation and AF confirm. Then next day you quit or fired does that makes the letter fraudulent or invalid....I think not.

        Point of correction....the lawyer did not reach out to the diplomatic office. In my humble view, she should have directed them to the Acting Premier or the Governor's Office, to be on the safe side, especially in light of what had happened.

        And again, who are you to demand the immediate release of anyone from lawful custody anyway. We should not be blindly loyal to anyone, if we are indeed working for the good of our country.

    Considering that Fahie was embroiled in this arrest and serious charges I think it was incumbent upon her to check with the person who she should answer to when Fahie is not here - dep. Premier? Archer? Perm sec? before writing this letter. It's the first thing I would have done in her position. My first thought would have been my job could be jeopardized in doing this. It was presumptious of her to feel that it was her sole responsibility.

    At the end of the day this comes down to ETHICS. As we move forward on this new political paradigm ethics is going to be the rule of the day. "Technically" Mr. Fahie still carried the title of Premier. At his present location, should he have been allowed to give instructions even if via his legal council?... NO! As it relates to the new unity government, there are persons like Ms. Christopher who may be loyal to "people" and not loyal to the integrity of the "OFFICE". The integrity of the office should always trump loyalty to people. That means that your functions and duties are to be held to the highest standard of professionalism and ethics regardless of party affiliation/family ties and this is the biggest problem we have in the BVI. Elected officials may have the best intentions and be sabotaged by rotten tomatoes.

    If she thought it was legal and within her rightful scope, she would have signed her name and full signature on the document. Furthermore the Virgin Islands Constitutional Order leaves diplomatic relations to her Majesty and not the government of the VI. Who was she to interpret this law? Did she get permission from the AG after she drafted the document? She needs to be arrested and give account of her actions.

    . I can not for the life of me figure out why you idiots can't understand that Fahie was the premier of the BVI up until Mr. Wheatly was sworn in. Why is that so hard to comprehed?       The issue is many of you want to use your legal degree whether achieved or imagined to justify actions to say whether or not she “could” rather than determine whether or not she “should”.     This whole 'rogue letter' debate is a tempest in a tea cup compared to the main issue of inmate Fahie's claim for 'diplomatic immunity'. This claim is only valid for HEADS OF STATE and in the UK that is the QUEEN. Even the dumbest kids in primary school know this fact. So please quit the endless bickering about who did what on May 3rd because it does not matter. What matters is the the 51 year old elected head of a British Overseas Territory erroneously believed that he was a head of state for the BRITISH Virgin Islands a mere colony in the Caribbean and so did Najan Christopher. How did A. Fahie and N. Christopher ever get through primary school is a mystery that will never be solved.

She went too far when she claimed he had Diplomatic Immunity, that is for the Governor to respond to. She overstepped her bounds by demanding Fahie be released and given free passage home

    Rogue? This was a blatant and egregious mistake and Najan should take accountability for it because she knows protocol - both internationally and officially. So yes, rogue is a appropriate descriptor. She won't be fired and she shouldn't be! Firing her would "prove a point" yes, but if only her good works, good governance and good projects were highlighted and broadcasted like this you might also see a Civil Servant who loves these Virgin Islands, its people, and history, and who usually works tirelessly to ensure that the BVI is well represented and engaged with the international community. Terrible mistake Najan. Own it and move forward. Keep your head up.

    When will Najan Christopher be arrested?? Here we go. If Najan Christopher is not arrested, then we know school is out and same old same old will reign in the BVI. Take cover all of you who outed yourselves publicly as wanting this corrupt Govt ended. No arrest of Najan, no end to the completely corrupt BVI Government and Public Service under John Rankin... Here we go. We are watching and waiting. . . and actually expecting to be disappointed by our Governor John Rankin, Police Commissioner and of course the stupid useless rat pack the Unity Party. Watching and the days are passing fast proving no justice in the BVI.
