Multi-year work permits could be solution to Labour congestion– Hon Wheatley

- but said it has to be done in a way not to disenfranchise locals

ROAD TOWN, Tortola, VI- Minister for Natural Resources, Labour and Immigration Honourable Vincent O. Wheatley (R9) said issuing multi-year permits in the Virgin Islands could be a solution to the congestion taking place at the Department of Labour and Workforce Department.

The situation at the Labour Department has been made worse with the staff shortage and the lengthy processing time for work permits because persons are mandated to renew their permits on a yearly basis.

The suggestion was put forward by a member of the public during the stakeholders meeting to address labour concerns held virtually on February 10, 2022.

When the suggestion was posed, Acting Labour Commissioner Michelle A. McLean said: “In the Labour Code yes there is provision for I think it is a three-year work permit. I think we would have to look at the specific industry because doing so would place BVIslanders/Belongers at a disadvantage.”

She explained: “Because you would appoint somebody with a three-year work permit and a BVIslander/Belonger may want to come home, they desire to go into another job and because of that, they are unable to.”

McClean further stated that she also doesn’t believe that it should be a ‘blanket statement.”

“We have to actually sit down and state in terms of what industry, and maybe put in a clause as to how long it may be; not necessarily be for the three years,” she pointed out.

Minister agreed

It was at that time the Minister for Labour intervened.

“I think it is an excellent question and I hear you commissioner and that would be my concern also. We have to make sure that as we get our labour force organised, that at the same time, we don’t disenfranchise the locals.”

Nonetheless, he stated that the idea is worth exploring deeper.

He explained: “because in the short term if somebody is going to get a two-year permit or you decide a certain number gets two years, it’s going to cut down on the congestion in the office for next year because the person would not come back next year and probably the following year. So it is something worth exploring and I am prepared to actually explore that, I like it. It is a very interesting suggestion and it is something that may work as a short term solution to avoid persons coming back too quickly again.”

The Labour Department has been under the radar these past few months with their staff shortage and the lengthy periods that employers and their employees or potential employees have to wait for the work permit processing.

    How many years has the BVI been dealing with work permits. We have been here 25 yrs. And they still have not figured it out. Please!!!! It’s not brain surgery. Or maybe it is lol.

    And after waiting for 4 months for work permit renewals and paying $550 they still charge you for a year knowing it’s only a few months the permit gonna be valid for!! So dishonest and cheeky. These ppl in labour dept can be so spiteful, not caring, disrespectful, and treat immigrants like they are beggars. There’s also a lot of nepotism presently going on in that department. Need restructuring and maybe change of commissioner too.

        Because the permit was submitted before the expired date in order for it to be process in time!! But labour department sits on it for months instead of processing permit, therefore it would not be the applicant fault working without permit for months while every time we check you guys tell us it’s not ready!! So wats your point again? Labour is at fault again for the incompetence so shut you trap if you don’t understand wats going on.

          You were allowed to work without the work permit it is only fair that the time you worked be deducted. Another alternative send your backside out untill the work permit is ready. May be then you will preasure your Government to find employment for you in your home country. It is craziness that you feel entittled in the BVI but not in your country. When you cannot make it in your country you lap your tail and leave but everything must be done the way you want in the BVI.

    so for business owners this would be a no brainer......if you own the trade license then a 3 year permit works for everyone.

    Make sure you factor in payment plans. Not everyone will be able to afford multi year work permit payments. 1200, X ..say...3 or 4 years all at once? Ouch

    This minister is like a medley singer.. He change tune often..His message change regularly.. dont know where he stands...However I like his tone and his leadership stands coming out of the news conference...He just need to make what he says and believe in happen..

    unless there’s a significant discount i can’t see any employee or employer wanting to pay for a 3 year permit. - too much uncertainty etc here.

    This is interesting. As a Bajan national to the core, I find this as an appropriate method to solve the issue. Bajans do not like to wait for things. It would be nice if we could implement a 10 year scheme, so this would be my last renewal before my belongership. Ah love the BVI bad!

    Someone mentioned during the stakeholders' meeting last week that perhaps the functions of processing at Labour could be farmed out to a private - for profit - firm. This idea is BRILLIANT! There's no profit in sitting on applications.
    The only downside would be having to then pass everything through the bottleneck of Labour Dept. management.
    It's time to reconsider privatising the process.

    Labour and immigration department - these are the two government entity need complete and systemic overhaul. These two dept putting residence and local under a lot unintentional stress and psychological torture. These two offices suppose to be welcoming and display excellent customer service but yet the majority of the population dread these two entities. WHY???
