Magistrate turns down Maynard’s weapon & assault dismissal request

Maynard has to return to court on March 29, 2012.
ROAD TOWN, Tortola, VI – Despite a passionate plea from Kadeem Maynard’s lawyer to have two charges, common assault and armed with an offensive weapon, dropped due to the Crown “foot dragging” – Magistrate Tamia Richards turned down the request on Monday, February 27, 2012.

In her application, Ruthilia Maximea told the court that since June 2011 she did not have full disclosure of the case and the lengthy waiting has caused undue stress to her client who has been unable to complete his business transactions.

However, Magistrate Richards in denying the request stated that the court was satisfied that there has been no inordinate delay in the matter.

She further stated that being charged with any offense would cause anyone to be stressed out and that was no reason for the court to execute its jurisdiction in dismissing the matter.

In light of this, the matter has been adjourned to March 29, 2012.
