Lorie Rymer concerned over 7.5% “gratuity cut”

Based on the new Labour Code, employers can deduct up to 7.5 percent from their staff’s gratuity.
ROAD TOWN, Tortola, VI – Lorie Rymer said he is concerned that employees in the hotel industry, especially in the 9th district, are being short-changed on their gratuity and wants something be done to change it.

In a recent interview with Virgin Islands News Online, the former 9th district candidate claims that certain employers deduct 7.5 percent from their staff’s gratuity.

“That is unacceptable. Those people work hard for their money since most of them are still being paid $4 per hour. If it’s in the Labour code, that has to be reviewed,” Rymer stated. “It was something I campaigned about, and yet there were persons who did not support the idea.”

According to the new Labour Code, the total amount of gratuity accumulated over every period of four weeks shall be deducted by the employer for Government tax, if any, on gratuity.

The code further stated, a further amount to be agreed by the employer and employee or if there is a Committee, the Committee but not exceeding seven and a half percent of the balance after the Government tax, if any, is deducted may be retained by the employer for administrative expenses.

If an employer, who contravenes this section, commits an offence, he or she is liable on summary conviction to a fine not exceeding $7,000.

    larry rhymer didn't you hear the lady said that in her speech at sea cow's bay ????she clearly stated that the ndp was the one that taxed the gratuity i am from jamaica and i work peter island and it was going on from 2003 it only now come out on black and white gratuity is tip and should not be taxed .

      Whilst i understand the pain we have to be factual. A gratuity is still income no matter how you look at it and should therefore be taxed. As far as the employer taking some of that gratuity in order to pay the tax - that is nonsense!

      The new labour code was passed under the old Government smarty. Further, if businesses are doing their workers wrong, they should be penalized accordingly! These people need to form a unit (union) and put forward their greviances as ONE FORCE! Unity is the only way to fight down this sort of behaviour!!

        Crankshaft, I am tolian, i don''t know where you from, but let the day come that a bunch au Jamaicans, Vincentians, Kittians, Dominicans etc form a union or a union formed on their behalf (or better yet, all our behalf), you gonna see the saaaaame Tolian dem what might be benefitting from the union start talking saying how, these down island people want to come in weee country and run our show. Furthermore, who ever is in charge of this unit might find it much easier to not renew person's work permit; forcing them to go back home. So therefore, I don't see how this union will be effective.

      Those on the bottom tier of the ladder needs an advocate. So what is wrong with Lorie looking out for their interest? I do not see anyone else looking out for them or bringing their issues into the sunshine. I applaud Lorie for not ducking and hiding after losing the election; he is out their fighting for the 9th and BVI in generally as aggressively as during the campaign. Good work VINO; you report the news---good, bad ugly. Lorie keep up the fight; you do not have to be in the HOA to contribute to the BVI. We need advocates for the top 1% and the bottom 50%. Why is it that when people speak up they are "mumys"? This is the label that Noel was tagged with and we know how wrong that was. Now AC Frett and Loire is being tagged with same label.
