Winter, a self-employed man, was offered $30,000 signed bail on the charge of assault occasioning actual bodily harm.
According to the allegations read by Crown Counsel Herbert Potter, the defendant resides with his wife, who is the Virtual Complainant (VC) and two children ages 4 and 7. Mr Potter told the court that Mr Winter was informed by the VC on August 21, 2013 that she wished to see her sister.
He reportedly told the VC that she couldn’t as he would be going out and would need to use the vehicle since the other was out of fuel. His wife then suggested that she would drop him off and pick him back up when he was ready but she was allegedly told she would not be leaving the home and an argument started.
Mrs Winter was allegedly dealt several punches to her face and told that she needed to leave the home by the time the defendant returned home. Potter told the court that the defendant said she was not leaving and this caused more blows to her head and face.
The defendant also allegedly held on to the VC’s head and squeezed her neck when she said she would report the matter to the police. She reportedly suffered injuries to her cheeks, forehead and neck as a result of the alleged assault.
A report was made to police on the same day and the VC was transported to Peebles Hospital for treatment.
When the defendant was arrested and cautioned the following day, he allegedly said, “Let me contact my lawyer,” and reportedly refused to do an audio/visual interview with police.
The defendant, who reportedly has eight children, is currently undergoing counselling for himself as well as in conjunction with his wife. Senior Magistrate Tamia Richards told Winter that as part of his bail conditions he is not in any way to ‘intimidate, harass, annoy or threaten’ his wife in any way and requested that any contact between the two remain cordial.
Winter will return to court on November 20, 2013.
