Judge ordering Speaker to pay ‘is a judicial overreach’– Skelton-Cline

BAUGHERS BAY, Tortola, VI- At least one clergyman has spoken out against the decision by Acting Commercial Court Judge Adrian Jack’s ruling that Speaker of the House of Assembly Hon Julian Willock should pay legal fees out of his own pocket despite filing an injunction in his capacity as Speaker of the House of Assembly.

Honourable Willock had sought an injunction against the Commission of Inquiry lawyers, Rhea Harrikissoon, Andrew King and Balil Rawat, who were accused of breaching the Legal Professions Act of 2015 by practising law in the territory while not being called to the Virgin Islands Bar.

Judicial overreach

“I feel this is a judicial overreach,” Skelton Cline said during his radio programme, Honestly Speaking, on ZBVI 780 AM on November 2, 2021.

Justice Jack, said to be a friend of CoI Commissioner Gary R. Hickinbottom, had taken over the case from another judge.

“I think it is tragic that we are allowing what should otherwise be an opportunity to show the strength of our character, of our constitution, of our laws, to be undermined by our infighting and bickering.”

The pastor questioned the residents of the territory, asking them where do they stand in the time of crisis and challenge?

“There has to be some principle that guides us as a people that we are committed to living up to, beyond personalities and beyond our personal politics. I want us, as tough as it may be for some of us, I want you to set aside personalities and politics for a moment,” he said.

Persons 'don't have to like the Speaker'

He said the Speaker, on behalf of the House of Assembly that he is a part of, sought to “remedy the situation” when he filed the injunction that had to be dropped because Attorney General Hon Dawn J. Smith did not respond to his letter asking for her consent to go ahead with the injunction.

“The Speaker, as I understand it in his official capacity, did such,” Skelton-Cline remarked.

He said persons do not have to ‘like’ the Speaker, but he is asking persons to ‘think and re-think again, how does a just judge adjudicate a case and then goes a step further, which seems to be going beyond judicial reach to assign costs to an individual in their private capacity when they are there acting in their official capacity?”

Since then, the Premier and Minister of Finance Hon Andrew A. Fahie (R1) is scheduled to move a motion today, November 3, to exempt the Speaker from paying the fees himself.

It will instead be paid from the Government’s Consolidated Fund.

A protest was held on Monday, November 1, 2021, by a handful of persons who said they did not want taxpayers to pay for the legal bill estimated to be in the region of $120,000.

    THINK People, think. Do you really believe the honorable Judge just wake up and pull at thought out of thin air. No sir.....the learned judge read the law and applied it.

    SO all this feeling and emotions and willy nilly nonsense is just to appeal to people's emotion and not logic.

      I so agree with you. He needs to take the matter to the Court of Appeal, not running to the HOA like a bloody cry baby.

      The Premier and by extension the House of Assemble are the ones who are over stepping by bringing a motion to the House. TAKE IT UP WITH THE COURT OF APPEAL. I'm sure they are not "biased".

    He says the judge and hickinbotttom are friends. Aww. He means like the way CSC and the Premier are friends? With benefits? I thought that was inevitable in a small community. Or is he now suggesting some conflict of interest? So where would that place CSC's dealings? When a judge makes a ruling, he has to specify the party whom the order is being made against. The judge needed to confirm if the order was meant to be against the Speaker on behalf of the HOA, or against the speaker personally. The AG said it had nothing to do with HOA. So if the judge is wrong, blame the AG sir!

    The irony being that the speaker was overreaching the scope of his duties that lead to this in the first place. Struggle to see how a judge awarding costs in a case that is heard in his courtroom is anything other than standard practice. There is always a risk when you bring court action that you lose and get costs against you. If the speaker was worried about that he should maybe have thought twice about making his application

    How do a government official reacting from that perspective get to interject himself as a private practitioner into governmental business. How? Were there not documents to be sign, contracts of hire for his lawyers to be sign? Were they sign as Speaker of the House or under his capacity as a citizen of the VI. If they were sign as John Doe citizen would that indicate fraud or impersonating a government official. You would think that some where along the line those concern would have had to be address. Help me understand how it got to the judge if not because of his designated official position as Speaker of the House. If that is the situation then Government is responsible for that bill. This has nothing to do with which side I'm on but just to have it make sense to me.

      The speaker as the judge pointed out is reaching outside the bounds of his responsibilities. His main duty after swearing in members of the house is to is to ensured the deliberations of the house are carried out in an orderly manner according to the rule and constitution. It has nothing to do with ensuring the members of a COI is legally appointed. That is the responsibilities of the Attorney General who have already stated that they were appointed under the law by her.
      So if he choose to act outside of the attorney general then he is acting as a private citizen and cost was awarded accordingly.

        If he is acting as a private citizen, why no charges have been brought against him. or why would any of the parties entertain his allegations? They were appointed under the law by the Ag. after the fact. So how could he be in breach of their appointment?
